April 2013

In April 2013, the Monitoring Service received 18 reports. Nine of them describe the factual situation in the media in the light of social, legal and political environment; five reports describe direct violations of rights of media professionals; and four reports describe conflicts and accusations against the media and journalists.

I. POLITICAL, SOCIAL, ADMINISTRATIVE AND LEGAL ENVIRONMENT DEFINING THE FACTUAL SITUATION IN THE MEDIA

1. Statements and actions of public officials defining the factual status of the mass media

24 April

 

Dunja Mijatovic, the OSCE Representative on Freedom of the Media

On 24 April, Dunja Mijatovic, Special Representative of OSCE on Freedom of the Media presented comments on Tajikistan’s draft law “On periodicals and other mass media” to the Parliament’s working group, which worked on that document. The new law was endorsed in March 2013.

In the letter addressed to the head of the Parliament’s working group, Mijatovic indicated a number of positive changes in the Tajik media legislation conducive to strengthening journalists’ rights and improving access to information.

However, the OSCE official stressed that the legislators and the executive authorities should develop practical measures to make the legal alterations efficient.

Dunja Mijatovic expressed appreciation over the involvement and participation of the civil society institutions in the development of the new law.

26 April

 

Ministry of Foreign Affairs, Dushanbe

The Asia Plus weekly (#30, 25.04.2013) published an article titled “MFA RT: Information war against Tajikistan is underway”.

The Tajik Foreign Ministry expresses concern over the information campaign conducted by the Russian mass media, which defames the image of Tajikistan.

“It is surprising that the information campaign involves Russian public officials, well-known public leaders and scientists”, — the MFA statement says. — “The information campaign against Tajikistan pursues certain political goals”.

26 April

 

Broadcasting Committee, Dushanbe

The Tajik Committee on Radio and Television gave an errand to private FM radio stations to arrange live broadcasting of the President’s message to the Parliament.

Usually, the annual speech of the President before the Parliament is broadcast by all government electronic mass media. This year, the state broadcasting agency decided to involve private media in Dushanbe; private radio stations in Sughd province have been practicing such broadcasting for a few years.

Asomuddin Atoev, chairman, Association of Internet Providers, Dushanbe

The Farazh weekly published an interview with Asomuddin Atoev, the chairman of the Tajik National Association of Internet Providers (#14, 3 April 2013).

Atoev shared his thought regarding the transition of the Tajik TV stations to the digital format of broadcasting in 2015. Atoev says that many residents of Tajikistan are not aware of such transition and keep buying old models of TV sets, which are not suitable for receiving digital signals.

The Farazh weekly (#17, 24.04.2013) published the results of an opinion poll on the freedom of expression in Tajikistan. The public opinion survey was conducted among well-known journalists.

Most of the respondents said that the Tajik legislation guarantees the freedom of expression, but in reality, the freedom of speech is limited in view of the number of reasons.

The Tajik journalist Rakhmatkarim Davlat told Farazh that many media professionals are practicing self-censorship, especially on the eve of the presidential elections, in fear of retaliation by the authorities.

 

3. Journalists protecting their civil and professional rights

4 April

 

Migration Service under the President, Dushanbe

The Imruz News weekly (#53, 3.04.2013) reports that the Executive Office of the President warned Safialo Devonaev, the head of the National Migration Service for violation of ethical norms in communication with the media.

In March 2013, the Migration Service held a press conference; journalists from the weeklies Imruz News, Farazh and Najot were not allowed to attend the event. Imruz News sent a complaint to the President’s Office, after which the incident was discussed. The President’s Office acknowledged that the actions of the Migration Service were unlawful.

4 April

 

All media, Dushanbe

The Tajik NGO Prevention of Domestic Violence (PDV) held a seminar in Dushanbe for media professionals on the issues of efficient prevention of violence in families and communities.

Twenty five journalists from Khatlon province and from Dushanbe took part in the seminar.

21 April

 

All Media, Kulyab

The authorities of the city of Kulyab in Khatlon province established an annual professional award for journalists. The award is named after the Tajik journalist Kuvvatali Kholov.

The award will be given to outstanding journalists contributing to economic, social and cultural development in Kulyab. The late Kuvvatali Kholov dedicated his life the the profession of journalism.

II. VIOLATIONS OF RIGHTS IN THE MEDIA

1. Ungrounded limitation of access to information

1 April

 

Abdujabbor Rakhmonov, rector of the State Pedagogical University, Dushanbe

The rector of the Tajik State Pedagogical University Abdujabbor Rakhmonov applied to the Somoni district police station demanding to launch an investigation into “illegal actions” of Markhaboi Khokim, correspondent of the Asia Plus weekly.

The journalist was working on an article about the students of the Pedagogical University; with that purpose, she was filming and talking with students. She was summoned to the rector’s office; the rector considers that the journalist had no right to take pictures and communicate with students without having a permission from the University administration.

On 5 April, the Somoni district police station concluded that the journalist’s behavior contains no components of crime or violation whatsoever.

 

3. Violation of economic rights in the media

26 April

 

Radio Vatan, Dushanbe

Private radio stations in the capital Dushanbe received an errand from the State Broadcasting Committee obliging them to broadcast the speech of the President Emomali Rakhmon at an annual meeting with the Parliament.

According to Vera Kulakova-Brannerud, director general of Radio Vatan, the government communication agency promised to help with technical arrangements for live broadcasting. However, the private radio company has its own commitments before its clients, advertisers. “According to the contract, we must broadcast ads and commercials strictly on time – advertisers have paid for that, and we have no idea how to resolve this problem”, — said Kulakova.

4. Denial of registration of a medium

30 April

 

Adolat, printing outlet of the Democratic Party of Tajikistan, Dushanbe

The leader of Tajikistan’s Democratic Party Saidjaffar Ismonov told Radio Ozodi (Radio Liberty / Radio Free Europe) that the Ministry of Justice refused to re-register the Party’s printing outlet Adolat referring to the fact that the newspaper has not been published for a long period of time.

The Democratic Party decided to rename its periodical into Oshkoro (Openness) and re-register the newspaper. The Party leader says that all relevant documents needed for the registration have been presented to the Ministry of Justice.

III. CONFLICTS AND VIOLATIONS

1. Protection of honor, dignity and business reputation

4 April

 

Imruz News weekly, Dushanbe

According to the Asia Plus weekly (#23, 1.04.2013), the Economic Court in Dushanbe suggested the conflicting parties in the case “Tojiron against Imruz News” to come to an amicable agreement.

Faizinisso Vokhidova, the lawyer of the Imruz News weekly told Asia Plus that the company Tojiron rejected this offer saying that the enterprise’s reputation has been affected.

2. Temporary denial of accreditation

20 April

Radio Sadoi Khuroson, Dushanbe

The Tajik foreign ministry terminated accreditation of journalists working for the Iranian Radio Sadoi Khuroson.

According to Abdulfaiz Atoev, head of the ministry’s unit responsible for contacts with media and foreign policy planning, Sadoi Khuroson used to disseminate false information, and it did it deliberately. The official referred to the statement made by Rakhmatillo Zoirov, the leader of the Tajik Social-democratic Party regarding the Tajik territories “donated” to China.

The official added that the foreign ministry is ready to reconsider its decision and resume the accreditation.

3. Accusation of administrative violations

2 April

 

M. Vokhitova, TV Jahonoro, Sughd province

The court in Bobojongafurov district, Sughd province determined the guilt of M. Vokhitova a journalist who worked for TV Jahonoro and ruled to she must pay a fine in the amount of 400 Somoni.

Previously, the court in the city of Khujand, the administrative center of Sughd province stated that the case against Vokhitova was closed because of the limitation period, but later, the materials were sent to the Bobojongafurov district court.

The journalist was accused of breaching administrative rules (Article 373, part 1 of the Tajik Administrative Code). The lawyer of Vokhitova says that “the person cannot be brought to responsibility if three months passed after the violation had been committed” (Article 33 of the Administrative Code).

In March 2013, the Monitoring Service received 21 reports. Fifteen of them describe the factual situation in the media in the light of social, legal and political environment; four reports describe direct violations of rights of media professionals; and two reports describe conflicts and accusations against the media and journalists.

 

I. POLITICAL, SOCIAL, ADMINISTRATIVE AND LEGAL ENVIRONMENT DEFINING THE FACTUAL SITUATION IN THE MEDIA

1. Statements of public officials defining the factual status of the mass media

11 March

Shukurjon Zukhurov, Parliament, Dushanbe

At a meeting with journalists, the chairman of Majlisi Namoyandagon Majlisi Oli (the Parliament) Shukurjon Zukhurov called on media professionals to restrain from committing mistakes to avoid conflicts with the authorities.

The meeting was organized on the eve of the Tajik National Press Day.

In recent time, there have been many legal proceedings caused by conflicts between the authorities and the media. The two latest cases are judicial complaints against the TojNews information agency and the ImruzNews weekly. Experts indicate a relation between the frequent lawsuits and the forthcoming presidential elections.

11 March

Gaibullo Afzalov, chairman of Khatlon province, Kurgan-Tube

The chairman of Khatlon province Gaibullo Afzalov held a meeting with media professionals on the occasion of the Tajik National Press Day.

The official indicated a big input of journalists and appreciated their efforts in social and economic development in Khatlon province.

Eight journalists working for government and private mass media received gifts from the administration.

11 March

Kokhir Rasulzoda, chairman of Sughd province

Chairman of Sughd province Kokhir Rasulzoda held a meeting with local journalists and gave them gifts on behalf of the administration.

The official acknowledged the hard creative labor of media professionals, which has a big positive impact on political and public developments in the society.

14 March

Saimurod Fattoev, state advisor to the President of Tajikistan, Dushanbe

The state advisor to the President of Tajikistan on social development Saimurod Fattoev indicated the feasibility and timeliness of an initiative launched by the Information-Communication Council under the President.

The initiative is targeted to promoting the culture of information in Tajikistan. In his letter to the president, the official supported the Charter of Members of the National Information Community in the Tajik segment of the Internet.

19 March

Emomali Rakhmon, President of Tajikistan

The President of Tajikistan Emomali Rakhmon signed a number of laws adopted by the Parliament.

On 19 March, the President signed the Law “On periodicals and other mass media”.

The official web site of the President says that “The new media law is adopted with the consideration of contemporary challenges; it defines organizational and legal bases for printing and other mass media; it provided guarantees of the freedom of speech and regulates relations in this area”.

2. Factual situation in the media and the freedom of speech

4 March

TV Poitakht, Dushanbe

The TV channel Paitakht will resume broadcasting on 4 March. According to Abdukodir Abdukahhor, director of the TV company, the station has received necessary spare parts for the transmitter from the Ukraine.

The broadcasting was terminated on 24 February by the reason of a technical failure. There have been many speculations regarding the “relation” between the forthcoming presidential elections and the termination of broadcasting. Abdukahhor denies such a relation.

12 March

Gaibullo Afzalov, chairman of Khatlon province

On 11 March, at a meeting with media professionals on the eve of the National Press Day, the chairman of Khatlon province Gaibullo Afzalov expressed concern over unsatisfactory work of local periodicals.

The official noted that the main reason for that is the lack of financing. He called upon heads of district administration to find resources for supporting the media.

13 March

Zarif Alizoda, Ombudsman, Dushanbe

Zarif Alizoda, the Ombudsman of the Republic of Tajikistan noted in the annual National Human Rights Report that the blocking of information portals and web sites (by the Tajik communication authorities) is the violation of citizens’ rights.

The Report published in March 2013, gives many examples of violations of basic rights, such as the right of free access to information.

In recent months, the Tajik communication service under the President repeatedly gave orders to local Internet service providers to block access to such web resources as Facebook, www.ozodi.orgwww.news.tjwww.tojnews.tj and many others.

The report says that “the limitations in access to web sites leads domestic Internet users away from sources of information, which has a negative impact on the national information security”.

14 March

All media, Dushanbe

The Millat weekly conducted an opinion poll among its readers to define the most influential printing outlets in Tajikistan.

“It is quite difficult to define the most influential newspapers… There have been two major periods in the development of the Tajik printing media – the Soviet period and the era of independence. In the Soviet time, the most popular were Charogi Ruz, Javoni Tojikiston, Adabiyot va Sanat, Maorif va Madaniyat, Adolat, Rastokhez, Sukhan, Sadoi Shark, farkhang, and Ilm va Khayot. In the psot-Soviet period, the most popular are Millat, Asia Plus, Farazh, SSSR, Charkhi Gardun, Niokh, Nerui Sukhan, Ruzi Nav, Odamu Olam, ImruzNews, and Najot.

15 March

TV Poitakht, Dushanbe

On 14 March, the Paitakht TV resumed broadcasting. The work of the TV company was terminated on 24 February because of a technical failure.

According to Abdukodir Abdukahhor, the director of TV Poitakht, the station will broadcast on weekends (2 hours in the morning and 6 hours in the evening), and during the weekdays, from 12 p.m. till midnight. This schedule will be valid until the full rehabilitation of the TV station’s broadcasting equipment.

The TV station was created in 2012. At present, it covers the whole area of Dushanbe and some of suburban districts.

28 March

Samad Khikmatov, deputy chairman of the TV & Radio Committee, Dushanbe

Two TV companies – Asia (Sughd province) and Simoi Mustakili Tojikiston expressed a desire to switch to the mode of digital broadcasting.

The intention was expressed at the national conference “Transparency and the realities of transition to digital broadcasting in Tajikistan” organized by the Sodeistvie Foundation.

Samad Khikmatov, deputy head of the government TV & Radio Committee stated that at present, the country has all technical capabilities for digital broadcasting. “Those who wish to start broadcasting in digital format can approach our agency, and we will provide you with an appropriate frequency and relevant technical services”, — he said.

At present, four state TV stations broadcast in digital format: Shabakai Avval (The First Channel), TV Safina, TV Jahonnamo, and the television for children Bakhoriston.

3. Journalists protecting their civil and professional rights

4 March

ImruzNews, private newspaper, Dushanbe

The ImruzNews weekly published an official letter of protest against the verdict of the Ismoili Somoni district court. The court ruled to apply administrative punishment against 12 public officials.

The lawsuit was initiated by Rustam Khukumov, a relative of an influential Tajik public official. The complainant had troubles with Russian law enforcement agencies in relation to drug smuggling; he spent some time in custody in Russia, but eventually, was released. Both Tajik and foreign media speculated a lot about Khukumov’s release from the custody and tension between diplomatic agencies of Russia and Tajikistan, which allegedly had a lot to do with Khukumov.

The statement released by ImruzNews indicates that the verdict of the judge Sherzod Nizomov is unlawful and unfair. According to the court decision, the newspaper must pay a moral compensation to the complainant in the amount of 50 thousand Somoni (more than $10 thousand) and to apologize for a publication “defaming” certain Tajik public officials.

The newspaper states that the judge conducted all court sessions in a “unilateral” manner, considering only the claims of Khukumov, and eventually, rendered the verdict in his favor. The editor of ImruzNews Naziri Nusrat said that the repeated declines of the newspaper’s claims is the evidence of the court’s unfairness.

The statement also says that the sessions held behind closed doors and numerous dismissals of appeals challenges the fairness of the Tajik judicial system.

 

4 March

TV Jahonoro, Khujand, Sughd province

The city court in Khujand closed the administrative case against a journalist of TV Jahonoro.

The lawyer Muhabbat Juraeva who protected the interests of the TV station, told the media that the case is closed according to Article 33 of Tajikistan’s Administrative Code, which says that a citizen cannot be brought to responsibility after the expiry of a three-month term after committing an offence.

On 6 September 2012, a journalist presented a TV story about a fire at the Korvon market in Dushanbe. The information was taken from the original source – a web site of the TojNews information agency.

The lawyer Juraeva repeatedly stated that the case against Mohira Vokhidova, head of the Jahonoro news unit was initiated unlawfully. The court launched investigation into the case according to Article 373 of Tajikistan’s Administrative Code (dissemination of media products).

 

28 March

All media, Dushanbe

The Tajik Union of Journalists and the Ministry of Culture launched a professional contest “Media Against Corruption”.

The contest will be conducted according to the action plan developed by the National Anti-corruption Council within the framework of the National Anti-corruption Strategy for the period of 2013-2020.

The main goals of this activity is strengthening of public awareness and changing the social behavior to prevent corruption and attract the mass media for creating a better environment for the implementation of the government’s anti-corruption efforts.

The Ministry of Culture invites legal entities (TV and radio companies, news agencies, creative unions, etc.) and freelance correspondents working for electronic and printing media.

Materials on 13 thematic nominations printed or broadcast in Tajik and Russian languages from 1 February 2013 to 1 February 2014, can be presented to the jury.

28 March

All media, Khorog, GBAO

The Tajik Union of Journalists and the Independent Media School “Tajikistan – XXI Century” held a seminar “The mass media and child’s rights” in the city of Khorog, the administrative center of Gorno-Badakhshan. The seminar attended by 15 media professionals from state and private institutions is funded by UNICEF.

Participants exchanged their experience and ideas in the area of public awareness on the issues of child’s rights. They also indicated the necessity of strengthening professional skills, studying legal and moral aspects of problems in that area, as well as the need of better cooperation between the media, government agencies and the civil society.

II. VIOLATION OF RIGHTS

 

1. Appeal from judgment

7 March

ImruzNews weekly, Dushanbe

On 7 March, the private weekly ImruzNews presented an appeal against the decision of the Ismoili Somoni district court on the claim of Rustam Khukumov who demanded a moral compensation from the newspaper in the amount of 50 thousand Somoni.

The editor of ImruzNews Naziri Nusrat told the media that the newspaper requires the recall of judgment with further reconsideration in a court of upper authority.

In October 2012, ImruzNews published an article titled “Khukumov and Bakiev are a real headache for their fathers”. In January 2013, Khukumov approached the Ismoili Somoni district court with a complaint demanding a moral compensation from the newspaper. Khukumov also demands a public apology from ImruzNews.

2. Accusation of defamation

ImruzNews weekly, Dushanbe

On 14 March, the economic court in Dushanbe started investigation into the complaint of the Tojiron company against the ImruzNews weekly and the lawyer Faizinisso Vokhidova for libel.

Journalists were allowed to attend court hearings.

At the hearings, Vokhidova stated that the investigation of this case in the economic court contradicts the provisions of Article 32 of Tajikistan’s Law on Economic Courts, but the Dushanbe city court ignored her statement.

19 March

Nigokh weekly, Dushanbe

The rector of the Tajik National Arts Institute Asliddin Nizomov demanded a moral compensation in the amount of 60 thousand Somoni for libel and insult from the Nigokh weekly and six professors who formerly worked at the Institute.

On 15 march, the Firdausi district court started hearings on the case. However, the claimant stated that he will be satisfied if the professor present their apologies in the newspaper, and is would be ready to recall his complaint.

On 13 February 2013, Nigokh published an article titled “Brain drain from the Arts institute”, which was seen as insulting by the rector.

3. Denial of accreditation of a foreign medium

28 March

Abdukayumi Kaiumzod, Radio Ozodi, Dushanbe

The Tajik Foreign Ministry denied accreditation of Abdukaiumi Kaiumzod, correspondent of the Tajik service of Radio Free Europe / Radio Liberty (Radio Ozodi).

The journalist told the Nigokh weekly (#1, 27.03.2013) that the problem emerged last year. Initially, the Ministry provided him with a short time accreditation (for three months), but later, officials did not prolong the accreditation. Kaiumzod says that he is not aware of reasons for such decision, but he keeps working for Radio Ozodi.

III. CONFLICTS, ALLEGED VIOLATIONS, ACCUSATIONS AGAINST THE MEDIA

1. Accusation of defamation

 

13 March

ImruzNews weekly, Dushanbe

The Tojiron company applied to the Supreme Economic Court with a complaint against the ImruzNews weekly and the lawyer Faizinisso Vokhidova demanding 50 thousand Somoni from the lawyer and a symbolic amount of 1 Somoni from the newspaper as a moral compensation for libel.

An article published by Nigokh (#40, 11.03.13) says that Tajik officials somehow demand this particular amount – 50 thousand Somoni – as a moral compensation, wishing to intimidate or destroy a medium or punish a journalist or a lawyer.

28 March

ImruzNews weekly, Dushanbe

At the first court hearing on the complaint of the Tojiron company against the ImruzNews weekly and the lawyer Faizinisso Vokhidova, the judge Azizbek Sharbatov suggested for the parties to find an amicable agreement.

Vokhidova told the media that the plaintiff’s attorney rejected the offer of the judge saying that “the matter concerns a deliberate dissemination of information defaming the company’s business reputation”.

In February 2013, the Monitoring Service received 17 reports. Five of them describe the factual situation in the media in the light of social, legal and political environment; nine reports describe direct violations of rights of media professionals; and two reports describe conflicts and accusations against the media and journalists.

 

I. POLITICAL, SOCIAL, ADMINISTRATIVE AND LEGAL ENVIRONMENT DEFINING THE FACTUAL SITUATION IN THE MEDIA

1. Statements of public officials defining the factual status of the mass media

 

3 February

Rakhmatillo Zoirov, leader of SDPT, Dushanbe

 

The leader of the Social-democratic Party of Tajikistan made a statement saying that Abdukayum Kayumzod is one of the best media professionals in the country. “In his work, Kayumzod provides no privileges neither to the authorities nor to the opposition”, — said Zoirov.

 

On 3 February, the Committee on amendments and changes in the law on presidential elections made a statement supporting Abdukayum Kayumzod, correspondent of Radio Ozodi (Tajik branch of Radio Free Europe / Radio Liberty). The statement was sent to the Tajik Foreign Ministry.

 

Earlier this year, the Foreign Ministry refused to prolong the accreditation to Kayumzod.

 

6 February

Robin Ord-Smith, ambassador of the United Kingdom to Tajikistan, Dushanbe

 

The Ozodagon weekly published an interview with Robin Ord-Smith, the ambassador of the United Kingdom to Tajikistan (#5, 6 February 2013).

 

Inter alia, the diplomat touched upon the issues of the freedom of expression and problems of journalism in Tajikistan. In his opinion, the authorities should observe the principles of the freedom of speech and create better conditions for the mass media. The ambassador stressed that the UK government cooperates with journalists, and he personally is an opponent of any limitations of liberties in the media.

 

2. Factual situation in the media and the freedom of speech

 

6 February

The US embassy to Tajikistan, Dushanbe

 

The embassy of the United States in Dushanbe published a statement regarding the accreditation of Abdukayum Kayumzod, correspondent of Radio Ozodi (Tajik branch of Radio Free Europe / Radio Liberty).

 

The embassy calls the government of Tajikistan to respect the freedom of the media; diplomats urge the Tajik authorities to establish a robust and transparent mechanism regulating accreditation of journalists and media outlets.

 

“The United States supports the freedom of speech, the free media and the right of media professionals to work without fear of censorship and persecution”.

 

13 February

Ozodagon weekly, Dushanbe

 

The Ozodagon weekly published an article titled “A whip for journalists” (#6, 13.02.2013) presenting the analysis of frequent judicial persecutions of journalists.

 

Inter alia, the newspaper mentions the lawsuit of the government Religious Affairs Committee against the journalist Amrullohi Nizom, the lawsuit of Rustam Khukumov against the ImruzNews weekly, and the lawsuit of Sojida Nazarova, director of a kindergarten against Abdullo Shukurov, correspondent of Radio Ozodi (RFE/RL).

 

In all these cases, complainants demand protection of their honor and dignity. Experts indicate a relation between the legal persecutions and the forthcoming presidential elections scheduled for the fall of 2013.

 

21 February

Rustem Safronov, Russia Today, Dushanbe

 

On 21 February, the advisor to the Director General of the Russian TV channel RT (Russia Today) met with the deputy of the Tajik Foreign Minister Nizomiddin Zokhidov.

 

The parties discussed the issues of cooperation in the information sphere and opportunities of strengthening contacts between the Tajik media and the Russian TV channel Russia Today.

 

“We are interested in expanding our audience. Along with that, we offer our Tajik colleagues free internship at Russia Today with a purpose of further cooperation”, — said Safronov.

 

RT (Russia Today) is a Russian international multilingual information TV company established in 2005. RT is a 24×7 information TV channel broadcasting through satellite in English, Arabic and Spanish languages.

 

II. VIOLATION OF RIGHTS

CPJ, international human rights organization

 

Committee to Protect Journalists (CPJ) indicates an alarming trend of pressure against the media in Tajikistan.

 

Domestic Internet providers frequently block access to certain web resources following orders of the government Communication Service. A statement launched on CPJ’s web site says that the authorities order to block local and foreign web sites that publish information criticizing the policies of Emomali Rakhmon and covering the issues of corruption, social and economic problems in Tajikistan.

 

According to CPJ, a number of web sites and portals, including Facebook and YouTube, were blocked thrice during last year, following orders from Beg Zukhurov, head of the Tajik government communication service.

 

“The Tajik authorities always deny their involvement in the blocking, referring to “technical maintenance”. However, in November 2012, Zukhurov publically called Facebook “a hotbed of libel”, adding that the access to the web site was initiated by a group of ‘civil activists’”, — the CPJ statement says.

 

CPJ also reports that Zukhurov’s deputy Rafikjon Shokirov referred to “certain amendments” to Tajikistan’s civil code, according to which it is prohibited to publish information defaming honor and dignity of citizens. The official failed to explain who comprise that group of ‘civil activists’. According to Shokirov, the communication service did not issue any written orders for the Internet service providers.

 

Referring to Tajik media experts, CPJ says that the ‘interested civil activists’ are public servants charged to control the Internet content and trace publications criticizing the president and bureaucrats.

 

CPJ says that the Tajik authorities intend to join the “regional club of Internet censors” (dictators of Uzbekistan and Turkmenistan) to limit access to such sources as BBC, Radio Free Europe / Radio Liberty, RIA Novosti, Lenta.ru, Asia Plus, TojNews, and Ozodagon. These very agencies published objective materials covering the topics of corruption in the government, growing unemployment, energy crisis and repressions against the media and religious groups.

 

2.  Ungrounded limitation of access to information

Farazh weekly, ImruzNews, Ozodagon, Najot

 

On 31 January, correspondents of the Farazh weekly, ImruzNews, Ozodagon, and Najot came to the Tajik government migration service to attend a press conference, but the organizers informed the journalists that they are in a “black list” and are not allowed to participate.

 

Abdullo Kodiri explained the journalists that the migration service does not welcome their presence because the newspapers they represent criticized the agency and the government.

 

3. Attack on a journalist

 

28 February

Abdurakhim Umarov, press secretary, customs service, Dushanbe

 

On 27 February, unknown individuals attacked Abdurakhim Umarov, press secretary of Tajikistan’s customs service. Umarov was delivered to the Interior Ministry hospital with bodily injuries.

The police initiated a criminal investigation, but the victim has no allegations about the motive of the crime.

 

4. Accusation of disorderly conduct

 

18 February

Amrullohi Nizom, TojNews, Dushanbe

 

The Shohmansur district court in Dushanbe conducted the first hearing on the complaint of the government Religion Committee and the Organized Crime Control Unit under the Interior Ministry against the correspondent of the TojNews information agency Amrullohi Nizom.

 

The defendant says that the chairman of the government Religion Committee initiated the case because of a series of articles criticizing the Council of Ulems (religious leaders).

 

Amrullohi Nizom also published a letter requiring a legal assessment of actions of officers from the Organized Crime Control Unit who came to the ImruzNews office to arrest him, and to evaluate the professional competence of the head of the Religion Committee.

 

On 19 February, the Shohmansur district court delivered a judgment, according to which the journalist is accounted guilty (Article 460 of the Tajik administrative code – disorderly conduct). He must pay a fine in the amount of seven minimal monthly salaries, which is 280 Somoni, an equivalent of $57.

 

Amrullohi Nizom intends to appeal the case in a court of superior jurisdiction. Media experts say that the accusation against the journalist was fabricated because of his insistence in attempts to have access to information.

ImruzNews weekily, Dushanbe

 

The Sino district court in Dushanbe started hearings on the lawsuit of Rustam Khukumov against the ImruzNews weekly.

 

Khukumov, the son of the director of the Tajik Railroads applied to the court complaining that the newspaper insulted him.

 

The judge, Sherzod Nizamov ruled that the hearings will be held behind closed doors, referring to the norms of Constitution and the Tajik civil-procedural code.

 

Khukumov applied to the court in January 2012 demanding a moral compensation form ImruzNews in the amount of 50 thousand Somoni. Thye demand is based on the publication in ImruzNews last year, titled “Khukumov and Bakiev are headache for their fathers” telling about conflicts between the sons of influential Central Asia public servants/politicians and the law enforcement agencies in foreign countries.

 

Legal experts say that the decision of the judge to hold the hearings behind closed doors is ungrounded – the public at large had known the facts about Khukumov long before they were described in the article published by ImruzNews.

 

26 February

CPJ, international human rights organization

 

The international organization Committee to Protect Journalists (CPJ) is concerned about court hearings being held in Tajikistan behind closed doors. A representative of CPJ Muzaffar Suleimanov told the media that the fine of 50 thousand Somoni as a moral compensation imposed on ImruzNews weekly can have a negative impact on the Tajik non-state mass media.

 

On 25 February, the judge Sherzod Nizamov ruled to oblige the newspaper to pay 50 thousand Somoni to the complainant Rustam Khulumov as a moral compensation for the publication “defaming his dignity and reputation”. The judge also ruled that the newspaper must publically apologize before the complainant.

 

The editor of ImruzNews told the media that the newspaper is going to appeal against the verdict to the court of upper instance.

 

III. CONFLICTS, VIOLATIONS OF RIGHTS

 

1. Defamation

The company Tojiron applied to the economic court with a complaint against the ImruzNews weekly and the lawyer Faizinisso Vokhidova. The company accused the defendants of libel and damage of business reputation. (Asia Plus, #15, 21.02.2013).

 

Tojiron demands public refutation of an article published by ImruzNews and a moral compensation of 50 thousand Somoni from the lawyer and a symbolic amount of 1 Somoni from the newspaper.

 

25 February

ImruzNews, Dushanbe

 

The Ismoili Somoni district court obliged the ImruzNews weekly to pay a moral compensation in the amount of 50 thousand Somoni to Rustam Khukumov, the son of the director of the Tajik railway company.

 

Gulchekhra Kholmatova, the lawyer of ImruzNews told the media that she is not satisfied with the court decision – since the requirements of the defendant were not taken into consideration and the trial was held behind closed doors.

 

The lawyer added that she intends to appeal against the verdict in the city court.

In January 2013, the Monitoring Service received 20 reports. Seven of them describe the factual situation in the media in the light of social, legal and political environment; seven reports describe direct violations of rights of media professionals; and six reports describe conflicts and accusations against the media and journalists.

I. POLITICAL, SOCIAL, ADMINISTRATIVE AND LEGAL ENVIRONMENT DEFINING THE FACTUAL SITUATION IN THE MEDIA

11 January

Asadullo Rakhmonov, chairman of the State TV & Radio Committee

At a press conference held in Dushanbe on 11 January, the chairman of the State Committee on Radio and Television Asadullo Rakhmonov told the media that the Party of Islamic Renaissance of Tajikistan (PIRT) has presented only one document to the government broadcasting agency, namely a letter of intent (or an application).

 

Prior to that, PIRT stated that a while ago, it submitted all necessary documents to the State TV & Radio Committee expressing its desire to create its own broadcasting body.

 

2. Factual situation in the media and the freedom of speech

4 January

Radio Isfara, Sughd province

A new private FM station was set up in the northern city of Isfara. The signal also covers bordering territories of the Isfara district in Tajikistan and Kyrgyz Republic.

The total broadcasting time is 16 hours a day. The radio station is public oriented. The broadcasting company was created with support from the State TV and Radio Committee under the government.

10 January

Kironshoh Sharifzoda, chairman of the Tajik Media Council, Dushanbe

The Farazh weekly published an article by the chairman of the Tajik Media Council Kirinshoh Sharifzoda hwere he presents his analysis of the Tajik media in 2012 (#2, 9 January 2013).

Analyzing activities of the Tajik media, the author comes to the conclusion that the year of 2012 did not bring any serious disturbances. No newspapers were closed, and protracted legal trials between the media and government agencies are over.

Amnesty International, international human rights organization

Referring to the latest report issued by the international human rights NGO Amnesty International, the Tajik private weekly Asia Plus informed the audience that the Tajik authorities suppress the freedom of expression (#07, 24.01.2013).

Amnesty International has raised a serious concern over the closure of the Tajik human rights organization Amparo by the authorities.

3. Journalists protecting their professional and human rights

16 January

The Tajik National Association of Independent Mass Media (NANSMIT) held a seminar in Kulyab, Khatlon province on the topic “Interrelation between government press services and the media”.

According to Nuriddin Karshiboev, chairman of NANSMIT, the process of formation of press services in the south of Tajikistan has not finished yet; only few of executive administrations in the cities of Kulyab and Vose function.

Davlatali Nazriev, head of the Tajik Foreign Ministry’s information, press and analysis department took part in the seminar.

18 January

Twenty representatives of government press services and the media took part in the final seminar “Interrelation between government press services and the media” in Dushanbe.

The event is organized within the framework of a project implemented by NANSMIT with assistance from the International Media Support (Denmark). Partners of NANSMIT are the department of information, press and analysis under the Tajik Foreign Ministry and the national press center of the public union Ittiloot va Muoshirat.

A series of similar seminars was conducted in Khujand, Kurgan-Tube and Kulyab. They were supported by other partner organizations in provinces.

The main goals of the seminars were to improve access of the media to government sources of information and to strengthen the skills of interaction between official press services and the media.

24 January

The Tajik Media Council, Dushanbe

On 21 January, the Tajik Media Council held an extraordinary meeting to discuss the legitimacy of the letter received by the newspaper Tojikiston from the Ministry of Culture. The letter concerned a recent publication titled “Sex in a restroom” (Tojikiston, #2, 10.01.2013).

The Media Council presented its recommendations based upon a discussion of the disuse. The document says that the authors of the article have raised an essential social problem, but they did not violate any ethical rules and standards – since the balance of opinions was observed in the publication.

II. VIOLATIONS OF RIGHTS IN THE MEDIA

1. Ungrounded limitation of access to online resources

18 January

Committee to Protect Journalists

The international organization Committee to Protect Journalists (CPJ) called on the government of Tajikistan to ensure unimpeded access to web sites, including the one belonging to Radio Ozodi (Radio Free Europe / Radio Liberty).

Internet users complain that they have lost connection to the Facebook social network and to the Radio Ozodi news portal. Managers of local Internet providing companies have confirmed off the record that they received an order from the government communications agency obliging the to block access to certain web sites. However, the national authorities deny this saying that they have given no orders whatsoever.

Muzaffar Sulaimonov, representative of CPJ told Radio Ozodi that his organization is concerned about the actions of Tajikistan’s authorities. Robert Mahoni, deputy chairman of CPJ stated in New York City that the systematic censorship of the Internet in Tajikistan along with threats to journalists and bloggers shows that through the threats, the government is capable of forcing the media to “perform their [government’s] dirty things”.

Mahoni stressed the necessity of opposing and protesting against the government’s actions.

2. Impediments to professional activities

17 January

 

Amrullohi Nizom, TojNews information agency, Dushanbe

On 16 January, four officers of the National Department on Countering Organized Crime under the Interior Ministry paid a visit to the TojNews information agency and tried to arrest Amrullohi Nizom, the agency’s correspondent. They ordered him to follow them for an interview, but the journalist did not obey the officers referring to the fact that they provided him with no subpoena.

According to Saimiddin Dustov, editor of the Nigoh weekly, the visit of law enforcement officers is related to the recent publication titled “Fine for a prayer” (Nigokh, # 42, 16 January 2013) where the author criticized the Religious Affairs Committee under the government.

3. Denial of accreditation

29 January

Abdulkayum Kauymzoda, radio Ozodi, Dushanbe

On 28 January, the Tajik media organizations – the Union of Journalists, NANSMIT, the Media Council, and the Media Alliance – issued a joint statement addressed to the Tajik foreign minister Khamrokhon Zarifi seeking explanation for denial of accreditation for the correspondent of radio Ozodi Abdulkayum Kauymzoda.

It is mentioned in the statement that the issue has been under discussion in the Tajik media and in social networks for several weeks, but the Ministry has provided no explanations on that.

31 January

Kevin Close, acting president of Radio Free Europe / Radio Liberty, Dushanbe

On 31 January, the acting president of Radio Free Europe / Radio Liberty Kevin Close sent a letter to the Tajik foreign minister Khamrokhon Zarifi asking the official to explain the reasons for decline of accreditation to Abdukayum Kayumzoda, the RFE/RL correspondent.

Levin Close noted in his letter that he is concerned about the decision of the Tajik foreign ministry.

4. Ungrounded limitation of access to information

24 January

The Samak weekly (#4, 23.01.2013) published results of an opinion poll conducted among journalists who answered the question “why public officials are reluctant to communicate with journalists?”.

Most of the respondents said that public officials mainly avoid questions, which concern directly their activities. Obviously, they are afraid of revealing shortcomings in their work and do not want to share this with journalists.

31 January

Imruz News, Ozodagon, Nahzat – news agencies, Dushanbe

Correspondents of the news agencies Imruz News, Ozodagon and Nahzat – Safarbek Kabirov, Abdugani Abduvahhobov and Mijgona Khalimova, upon their arrival to the government’s Migration Service, learned that their names are in a “black list”.

They were informed about that by Abdullo Kodiri, press secretary of the organization. The journalists tried to find out the reasons for such attitude and treatment. According to the correspondent of Imruz News Safarbek Kabirov, he was explained that his newspaper criticizes activities of the Migration Service, and this is why the journalists are not welcome here.

31 January

Valentina Kasymbekova, freelance journalist, Dushanbe

On 24 January, Valentina Kasymbekova, freelance journalist came to the Ministry of Finance on the errand from the Asia Plus weekly to get the data on the national budget for 2013; two weeks prior to the visit, the newspaper made an official request to the Ministry.

In a conversation with Narzullo Abibulaev, head of the State Budget department, the correspondent reminded that she needs a full package of documents – not only the Law of the Republic of Tajikistan “On State Budget for 2013”, the document, which does not contain peculiar segments of information.

The official said that the requested information contains some classified data, which cannot be shared with journalists. Kasymbekova suggested to exclude the military and defense “classified data” and receive the data on other items of the national budget.

Abibulaev stated that he will only share the information that he considers appropriate to be shared with the media, and added that he has no time to communicate with journalists.

On 26 January, Kasymbekova received an official answer from the Ministry of Finance containing only the text of the Budget Law for 2013 along with brief information on local budgets. In fact, the journalist received only a “buck slip” from the Ministry, and the newspaper got nothing for the publication it was going to prepare.

III. CONFLICTS, VIOLATIONS INCRIMINATED TO MEDIA AND JOURNALISTS

1. Defamation

16 January

The government Agency on Construction and Architecture

On 16 January, Abduvali Komilov, director of the government Agency on Construction and Architecture accused the media of biased publications about Tajik labor migrants and their remittances from abroad. He shared this concern at a press conference on the issues of labor migration.

The official asserts that Tajik journalists “should not tackle the problem this way”. In a mentoring manner he accused the media of the lack of professionalism and objectivity.

17 January

Abdullo Ashurov, Radio Ozodi, Dushanbe

Sojida Nazarova, director of a kindergarten #93 filed a suit against the correspondent of the Tajik service of Radio Ozodi Abdullo Ashurov.

According to Khurshed Khamdam, head of Radio Ozodi in Tajikistan, the manager of the kindergarten complains that she has lost her job, and her facility’s image has been ruined because of the publication.

In October 2012, on its web site, Radio Ozodi published complaints of parents whose children attend the kindergarten #93. They complained about bив treatment by the personnel referring to concrete examples.

Khurshed Khamdam says that all arguments against the kindergarten were expressed by parents, and Radio Ozodi keeps the records with the parents’ complaints.

The former director of the kindergarten demands public apologies from journalists with a written copy to be sent to the Ministry of Education. Apart from that, she demands a moral compensation in the amount of 50 thousand Somoni.

17 January

Tojikiston, private newspaper, Dushanbe

The independent weekly Tojikiston (#3, 17.01.2013) complains that it received a letter from the Ministry of Culture accusing the outlet of promoting pornography. It concerns the publication “Sex in a restroom” (#2, 10.01.2013) where the author described cases of dissemination of pornographic videos through online sources by an unknown individual.

The Ministry’s officials have seen “promotion of pornography” in the publication, and they warn that the newspaper will be closed down if similar articles keep appearing.

The editor and correspondents stated that they will continue their own investigations of such cases informing the public about depravity in the society.

24 January

Council of Justice, Dushanbe

The Nigokh weekly (#44, 23.01.2013) published a response of the deputy chair of the Tajik Council of Justice A. Iskhakov titled “the dedia don’t have the right…” following the publication by the Tajik NGO Amparo “The fly keeps struggling with the elephant”.

Iskhakov asserts in his letter that the case of the human rights NGO Amparo is istill being considered by the courts of appeal, i.e. the case is not closed. According to part 3 of Article 7 of the Constitution (Courts of the Republic of Tajikistan), the media have no right to publish results of preliminary court proceedings; the same is reflected in part 3 of Article 29 of the Tajik Media Law. It is considered as an attempt to influence public opinion.

1. Statements of public officials defining the factual status of the mass media

3 December
Beg Zukhurov, head of the government communication service, Dushanbe

After a telephone conversation with Mark Zuckerberg, the founder of Facebook, the head of the Tajik government communication service, Beg Zukhurov stated that his agency intends to unblock this social network.

The Interfax news agency quoted Zukhurov as saying the following: “I have brought to the notice of the distinguished Zuckerberg that many citizens of Tajikistan who experienced a civil war are resentful about extremist appeals and libel disseminated through his social network”.

The Russian news agency RIA Novosti also quoted the official as saying that access to the web resource will be opened within the next few days “after resolving some technical problems”.

10 December
Olimjon Salimzoda, chairman of the International Relations, Public Unions and Information Committee under the Parliament, Dushanbe

Olimjon Salimzoda, chairman of the Parliament Committee on International Relations, Public Unions and Information told the Asia Plus news agency that the Parliament approved the draft law on “Periodicals and other mass media”.

According to the official, this media law is going to be the best among the similar profile laws in the countries of Central Asia.

According to the amendments to be introduced in the law, state agencies will be obliged to present official responses within three days after requests from journalists. At present, ministries and government bodies are obliged to provide answers to the media within one month after a request.
Salimzoda is confident that the amendments in question will strengthen responsibility of public officials.

“The final draft law was developed on the basis of remarks and suggestions from national and international media organizations and experts”, — he noted.

12 December
Sukhrom Sharipov, member of Parliament, Dushanbe

At a session of the Parliament where parliamentarians discussed the media draft law, Sukhrob Sharipov stated that the new legislation is in compliance with the international standards of the freedom of speech.

He also noted that Tajik journalists are very active in protecting the national interests making their valuable contribution in the discussion of delicate and controversial issues.

“I can expect that the Tajik media may criticize the draft law, but I would also say that ideal laws do not exist anywhere in the world”, — he said.

2. Amendments to legislation affecting the media

12 December
Parliament, Dushanbe

On 12 December, Tajik parliamentarians adopted a new law “On periodicals and other mass media”.

Initially, the draft law was submitted to the Parliament for consideration and discussion in March 2010. The lower chamber of the Parliament set up a working comprising government officials, parliamentarians, members of political parties and media professionals.

According to the new law, from now on, all media shall register as legal entities; state institutions are obliged to respond to journalists’ requests within three days (previously, it was three months).

3. Journalists protecting their civil and professional rights

1 December
The Council of Press Secretaries, Dushanbe

On 29 November, press secretaries and heads of press services under the government agencies created their public organization – the Council of Press Secretaries of Tajikistan.

The organization has adopted its charter; participants elected a chairman and appointed members of the revision commission.

Davlatali Nazriev, head of the Foreign Ministry’s Information, Analysis and Foreign Policy Planning Department is elected the chairman.

The Council’s board comprises representatives from the Parliament, the Ministry of Health, the Drug Control Agency under the President, the Anti-corruption Agency, Prosecutor General’s Office and the TV & Radio Committee.

The new organization pursues the goal to cooperate with the mass media, press services of government agencies, provision of comprehensive and veracious information, and improvement of professional and creative skills among journalists.

1 December

On 30 November, the Tajik Media Council held its annual conference. Participants noted, inter alia, that the Council does not fully apply its potential in working with regional mass media.

Another issues discussed at the Council was the necessity of strengthening the system of pretrial dispute and conflict resolution (between the media and government bodies or public officials).

The Media Council was created in 2009. The founders of the Council are the Tajik Union of Journalists, the National Association of Independent Mass Media, the Association of Electronic Mass Media, the Memorial Fund for Protection of Journalists. The Council was created under support of the OSCE Bureau in Tajikistan.

7 December
All media, Khujand, Sughd province

On 7 December, NANSMIT held a session of the Club of Journalists to discuss rights and duties of media professionals in covering legal proceedings.

In particular, journalists were interested in learning about video and audio recordings during legal proceedings in court. The lawyer Sadriddin Saidov explained that the minimal requirement is permission from the judge and the defendant; besides that, the journalist must notify the parties that he/she intends to carry out a video or audio recording.

7 December
All media, Dushanbe

On 7 December, NANSMIT held a round table session in Dushanbe to discuss the role of public television in developing diversified and interesting programs and contents that meet expectations of the audience in the era of the Internet. The session was organized by the BBC International Cooperation Department.

Participants discussed the tasks of government and non-state electronic mass media and the trends of editorial policies of the Tajik TV companies.

10 December

The Tajik NGO Independent Center to Protect Human Rights launched a project “Legal assistance to the mass media” supported by the Norwegian Helsinki Committee.

According to Shoira Davlatova, project coordinator, the purpose of the project is legal assistance to the media in conducting voluntary legal audits.

The Independent Center to Protect Human Rights is a group of licensed lawyers specialized on protection of public interests. This group has its own analytical potential.

19 December

On 19 December, NANSMIT made a presentation of profile literature (study guides and textbooks) to the Nosiri Khusrav University in Kurgan-Tube.

Nuriddin Karshoboev, chairman of the National Association told professors and students that NANSMIT publishes its own original literature, and it also has access to resources of partner organizations – media and human rights entities.

20 December
All media, Dushanbe

On 20 December, NANSMIT and the Finnish VIKES Foundation held a training for young journalists OF Central Asia to discuss the issues of labor protection and labor legislation.

Participants discussed practical issues related to violation of labor rights by employers. They received information on international standards of labor legislation based on study cases.

Young journalists expressed concern over the absence of professional trade unions and stressed the necessity of creating bodies to regulate labor relations between employees and employers.

II. VIOLATION OF PROFESSIONAL RIGHTS

1. Ungrounded limitation of access to information

1 December

Radio Free Europe / Radio Liberty, Dushanbe

On 29 December, managers of a few local Internet providing companies told the Asia Plus news agency that they received SMS messages from the government communications service demanding to close access to www.ozodi.org, the official web site of Radio Free Europe /Radio Liberty.

 

According to managers of the Internet providing companies, this demand of the authorities is related to the recent interview with Beg Zukhurov, head of the government communications body. The Tajik service of RFE/RL asked certain uncomfortable questions to the public official who recently ordered the Internet providers to close access to Facebook, the global social network for Tajik Internet users.
Zukhurov’s statement regarding the closure of Facebook in Tajikistan entailed a number of jokes and poignant remarks in the media and in other social networks, as well as serious criticism of the Tajik government violating basic rights of citizens.

Reporters Without Borders, Paris

On 2 December, the Paris-based media organization reporters Without Borders issued a statement criticizing the Tajik authorities for blocking the web site of Radio Free Europe / Radio Liberty.
Johan Bir, head of the organization’s Eastern Europe and Central Asia unit raised concern about the actions of Tajik officials calling them for unblocking access to Facebook and Radio Ozodi.
3 December

The US embassy in Dushanbe is seriously concerned about the blocking of access to Facebook, Radio Ozodi and a number of other online resources.

 

The embassy issued a statement saying that “the right for freedom of expression is universal, and this right must remain universal everywhere – in a public place, in the Internet, or anywhere else… We call the Tajik authorities for observing these rights and unblocking access to Facebook, Radio Ozodi and other web sites”.

Asomiddin Asoev, Association of Internet Providers in Tajikistan, Dushanbe

On 5 December, a number of Tajik Internet providers unblocked access to Facebook – the social network was blocked since 26 November.

Assomiddin Atoev, chairman of Tajikistan’s Internet Providers Association told the media that the state company Tajiktelecom was the first who unblocked access to Facebook. “Probably, the other providers have not received the order from the authorities, but I believe that they will follow Tajiktelecom very shortly”, — he added.

7 December

On 6 December, the Office of the European Union in Dushanbe issued a statement expressing concern over the recent blocking of access to Facebook, Radio Ozodi and a number of other web resources.
“Although access to certain web sites has been restored, the European Union is concerned about rather frequent obstacles of such kind, which raises concern over the media freedom in Tajikistan”, — the statement says.
Representatives of the European Union reminded the Tajik authorities about the Tajikistan’s commitments to observe international conventions and follow the standards of the freedom of expression.
Representatives of the European Union are confident that the Internet must serve as a forum for exchange of information and ideas.
2. Ungrounded limitation in access to information

20 December

Jumkhuriyat weekly, Dushanbe

The Asia Plus weekly (#96. 20.12.12) published an article titled “The government media promise to criticize”. This is a set of interviews with recently appointed editors of government newspapers – Narodnaya Gazeta, Khalk Ovozi, and Jumkhuriyat.

 

Asia Plus reports with regret that the editor of the Jumkhuriyat weekly refused to answer the questions referring to his personal dislike of Asia Plus and criticism in a publication on www.news.tj .

3. Impediments to professional activities

13 December

Daler Sharipov, freelance journalist, Dushanbe

Servicemen of the National Security Committee in Kumsangir district refused to return video records from the funeral ceremony of Domullo Mukhammadi Kumsangiri, a spiritual leader who passed away in November. The video recording was performed by Daler Sharipov, a young journalist who wanted to write a story about the life and activities of Kumsangiri.

 

After the funeral, the journalist was detained by the National Security officers who confiscated his video records and interrogated him for more than one hour. Sharipov said that the officers promised to return the video records, but one month later, they did not keep their promise.
Daler Sharipov is a former correspondent of the Safina TV and the leader of an unregistered organization Kadam ba Kadam; he is a well known host of TV shows. In May 2013, he was attacked and brutally beaten by persons unknown; the investigation on that case proved to be futile.

 

17 December
ImruzNews weekly, Dushanbe

Naziri Nusrat, correspondent of the Tajik private weekly ImruzNews published an article titled “Two meetings and persecution of journalists” (#222, 17 December) where he described facts of intimidation of journalists.

The author told about a meeting of journalists with parents of convicts near the prosecutor general’s office. The meeting was accompanied by a car with tinted glasses; participants of the meeting tried to change their location, but the vehicle kept following them.

 

Journalists see intimidation in such actions; however, the unknown persons in the car did not undertake anything else, which might be interpreted as persecution or harassment.

 

III. CONFLICTS, VIOLATIONS, ALLEGED CRIMES

1. Accusation of defamation

22 December

Saidmukarram Abdukodirzoda, head of the Council of Ulems, Dushanbe

On 21 December, at a Friday sermon, the chief mufti of Tajikistan and the head of the National Council of Ulems Saidmukarram Abdulkodirzoda publically accused the Tajik media of exaggerations in publications about tortures in prisons. The sermon was held in the central mosque in Dushanbe; it was attended by hundreds of parishioners.
“The press is lying. I personally visited several prisons during three days, I spoke with inmates and I learned about the conditions in those institutions. There are no tortures there, no cruel treatment; journalists lay on the colors too thickly”, — the spiritual leader stated.
Nuriddin Karshiboev, chairman of NANSMIT called the accusations of the mufti ungrounded. “Journalists cover this issue in a balanced manner; they provide the floor not only to victims of tortures and their relatives, but also to the law enforcement agencies and government structures”, — he said.

In November 2012, the Monitoring Service received 18 reports. Ten of them describe the factual situation in the media in the light of social, legal and political environment; six reports describe direct violations of rights of media professionals; and two reports describe conflicts and accusations against the media and journalists.

 

I. POLITICAL, SOCIAL, ADMINISTRATIVE AND LEGAL ENVIRONMENT DEFINING THE FACTUAL SITUATION IN THE MEDIA

1. Statements of public officials defining the factual status of the mass media

1 November

Emomali Rakhmon, president of Tajikistan, Dushanbe


According to the president’s office press service, the president of Tajikistan Emomali Rakhmon relieved a number of public servants from their duties. Among them are the deputy head of the government broadcasting committee, editors of the newspapers Narodnaya Gazeta, and Khalk Ovozi, and two deputy directors of the Safina TV. In the president’s dismissal list are also the editor of Jumkhuriat weekly and the editor of the magazine Bonuvoni Tojikiston.


10 November
Emomali Rakhmon, president of Tajikistan, Dushanbe

At a ceremony on the occasion of the National Police Day, the president of Tajikistan Emomali Rakhmon noted that “certain extremist groups widely use modern information and communication technologies, including the Internet to disseminate ideas of violence and terrorism, especially among young people”.

 

In this regard, the president gave an errand to the Tajik Ministry of Interior and other relevant government agencies to create a special unit under the Ministry to counter information crimes. The Interior Ministry is asked to present its proposals on this issue to the government.


2. Public speeches, statements of public officials defining the situation in the media environment

Speaking at a ceremony on the occasion of the National Police Day, the president of Tajikistan Emomali Rakhmon touched upon the issues of information and communication technologies in all spheres of socio-economic life. Along with other challenges, the president mentioned the Internet terrorism and cyber crimes. “Modern technologies can be used by criminals pursuing their destructive goals”, — said Rakhmon.


3. Factual situation in the media and the freedom of speech


1 November
TV Poytakht, Dushanbe

On 1 November, TV Poytakht, which founder is the mayor’s office in Dushanbe, started broadcasting in the mode of 24×7.

 

According to Abdukodiri Abdukahor, director of TV Poytakht, the TV station covers 2 million of residents – in the capital and its suburbs. The director is soliciting support of the mayor in getting funds to increase the number of personnel at the TV station up to 50 specialists. Paytakht also plans to increase the number of news programs and diversify its broadcasting. Special attention will be paid to the quality of produced materials.


16 November
Farazh weekly, Dushanbe

The Farazh weekly published an article indicated problems among the Tajik printing media – the problems are caused by the newly adopted Tax Code. (“Who will benefit from the bankruptcy of the printing media?”, #46, 14.112012).

 

“Private newspapers cannot afford paying eight types of taxes – it implies bankruptcy”, — says the article. The authors say that the authorities deliberately destroy the independent media creating big tax burden.


4. Journalists and the media protecting their professional and civil rights

11 November
All media

Editors of many Tajik non-state media and leaders of media organizations and legal associations created a Committee to protect professional rights of journalists.

 

The new entity called Committee – 29 September is created with the purpose of developing a strategy for the Tajik media community to protect the freedom of creative activities and better coordination of efforts in the media environment.

 

The Committee is open for new members – the media, public and human rights organizations.


19 November
All media, Kurgan-Tube

On 16-17 November, the Tajik National Association of Independent Mass Media held a seminar “Improving efficiency of cooperation between the media and government press services”. The event held in Kurgan-Tube, the administrative center of Khatlon province was supported by local government’s press service.


More than 20 journalists and press secretaries took part in the seminar. Participants learned about standards and best practices of organizing press conferences and efficient methodologies strengthening communication between government press services and journalists.

 

Participants suggested to organize similar events for all state managers and heads of public agencies.


19 November
All media, Dushanbe

On 19 November, Nuriddin Karshiboev, chairman of the Tajik National Association of Independent Mass Mediatold the TJinform news agency that representatives of the government press services intend to create their own professional association.


Representatives of the state press services were inspired by the seminar “Improving efficiency of cooperation between the media and government press services” held in Khatlon province by NANSMIT.

 

For the time being, a steering committee is created comprising representatives of press services of the foreign ministry, the ministry of education, the ministry of health, the border protection committee, and the women’s committee under the government.


20 November

The British Institute for War and Peace Reporting (IWPR) held a training for radio journalists on computer audio editing.

 

Shahodat Saibnazarova, correspondent of IWPR told NANSMIT that the organizers have held classes on technical skills of working with the software Adobe Audition. The main purpose of the training is to give radio journalists skills of editing, such as noise reduction, mixing, etc.


24 November

On 24 November, the Tajik National University hosted a scientific-practical conference “Challenges for the media in the years of state independence”.

 

Scholars and media professionals discussed and analyzed topical issues of contemporary journalism, modernization of education, training of skilled specialists, etc.


The faculty of journalism at the National University has been holding such conferences annually since 1992. This conference was attended by 70 participants – professors, journalists and media managers. More than 20 reports and works presented at the conference will be published in one book.


II. VIOLATION OF RIGHTS IN THE MEDIA

1. Limitation of access to web resources

9 November
Asia Plus weekly, Dushanbe

The Asia Plus weekly published an article (#84, 8 November 2012) analyzing an initiative of the government communication service. The agency in question intends to create a “unified IP monitoring center”. In the essence, the government communication agency suggests to introduce a system of total surveillance and control and to monopolize the communication sector.


This “initiative” is not something brand new – the government communication service has been trying to promote its idea for a few years, but the authorities declined the proposals, analyzing critical remarks of independent communication experts.

 

26 November
All media

A number of Internet providers in Tajikistan have blocked access to the popular social network Facebook. The providers received a verbal errand from the government communication service, which does not provide any explanation about the reasons. The media cannot receive any comments from the communication agency.


Certain Internet providers are reluctant to block access to Facebook waiting for explanations and further instructions from the authorities.


26 November

On 26 November, Internet providers in Tajikistan blocked access to the social network Facebook.

Asomuddin Atoev, chairman of the Tajik National Association of Internet Providers told Radio Ozodi (Radio Free Europe / Radio Liberty) that the local companies had received an order from the government Communication Service “to limit access” to Facebook. The government agency did not provide any explanations about the reasons of its order.


Atoev also said that on 26 November, certain Internet providers already blocked access to the social network, and others were going to do the same. Subscribers of the Babylon M and the Biline companies also confirmed to Radio Ozodi that they have no access to Facebook.


It is “remarkable” that this time, the blocking of access to the Internet is “dedicated” to the World Information Day (it has been celebrated around the World since 1994, following the initiative of the International Informatization Academy, which has a status of consultant at the Economic and Social Councils under the United Nations, and the World Information Sociological Parliament.


27 November

Beg Zukhurov, head of the government Communication Service, Dushanbe

Head of the Communication Service under the Tajik government told the media that he is looking forward to have a personal meeting with Mark Zuckerman, the founder of Facebook. Beg Zukhurov said that he is willing “to discuss the order of work of the social network”, as well as possibilities to control critical remarks addressed to Tajik public officials and entrepreneurs.

 

Zukhurov also stated that his agency has received a number of complaints from Tajik citizens who are “indignant about slanderous publications and remarks targeted against certain government officials”.


Zukhurov was quoted by BBC as saying the following, “Does Facebook have the owner? Can he come to Tajikistan? If he has no time, I am ready to have a meeting with his assistants”.

 

2. Impediments to professional activities

24 November

Daler Sharipov, freelance journalist, Kumsangir district, Khatlon province

On 22 November, officers of the National Security Committee in Kumsangir district held an interrogation of Daler Sharipov, a young journalist and the founder of unregistered non-governmental organization Kadam ba Kadam.

 

Sharipov told Radio Ozodi (Radio Free Europe / Radio Liberty) in a brief telephone conversation that he was detained by the officers, after which he was delivered to the office and left there for one hour without any explanations.

 

In a telephone conversation with Radio Ozodi, the National Security officer explained that Daler Sharipov and his friend Rajabali Kalandarov performed a video shooting at the funeral ceremony of a local spiritual leader Domullo Mukhammadi Kumsangiri. The two citizens were invited for a conversation “to find out more about their intentions”. The officer told Radio Ozodi that the young people were released after the conversation and the “measures were undertaken to ensure security in the border area”. (the district borders on Afghanistan).

Daler Sharipov is a former correspondent of Safina TV and the leader of the unregistered NGO is also known as the author and the host of the popular TV talk show Muoshirat.


2. Ungrounded limitation of access to information

22 November

The SSSR weekly, Dushanbe

Sayofi Mizrob, chief editor of the SSSR weekly published an article speculating on the Tajik president’s errands and decrees – those initially targeted to supporting freedom of the media and expression (#47, 22.11.2012).

 

In February 2009, Emomali Rakhmon endorsed the Decree #622 obliging ministers and heads of government agencies to provide timely feedback on publications in the media criticizing the work of the government bodies and administrations at all levels.

 

The author says in his article that initially, the officials properly reacted on criticism in the media. However, this initiative was gradually forgotten, and the public servants ignore the president’s errand.

III. CONFLICTS, VIOLATIONS, ACCUSATIONS AGAINST JOURNALISTS AND THE MEDIA

1. Demand on refutation of information

14 November

Jahonoro TV, Chkalovsk, Sughd province

Managers of the private TV company Jahonoro in the city of Chkalovsk, Sughd province, applied to the court demanding to dismiss the case against the TV station.

 

In September 2012, the Sughd province court initiated civil proceedings against the director of Jahonoro TV Makhmudjon Dadoboev (Article 373 of the Tajik Administrative Code). As a result, the director had to resign.

 

19 November

Muhabbat Juraeva, lawyer of TV Jahonoro, Khujand, Sughd province

The lawyer of TV Jahonoro Muhabbat Juraeva appealed the case initiated by the prosecutor’s office in Sughd province against Mohira Vokhidova, the editor of the TV company in question. The lawyer told the media that the case was initiated groundlessly.

 

Earlier this year, in a news program, TV Jahonoro quoted information about an accident at a marketplace in Dushanbe. The information was taken from the web site tojnews.tj, which is legal – according to Article 36 of the Tajik Law on Television and Radio Broadcasting, any information received from news agencies can be used by the media if they indicate the source of information. The medium is released from responsibility if the information proved to be unreliable or questionable.

I. POLITICAL, SOCIAL, ADMINISTRATIVE AND LEGAL CLIMATE IN THE COUNTRY DEFINING THE FACTUAL SITUATION IN THE MEDIA

1. Public speeches and statements of superior officials defining the factual situation in the mass media

8 October

Emomali Rakhmon, President of Tajikistan, Dushanbe

Speaking at the National Language Day celebration on 5 October, the Tajik President Emomali Rakhmon harshly criticized the linguistic manner and style of many publications in the local printing media. Newspaper Samak (#41, 8 October 2012).

The newspaper conducted an opinion poll among experts about shortcomings in the media. The vast majority of interviewees support the President’s viewpoint, saying that publications often contain poorly verified facts; the language is also obscure; and very few analytical publications touch upon topical issues relevant for the country.

2. Amendments in the legislation affecting the media freedom 

1 October

On 1 October, deputies of the Tajik Parliament’s lower chamber adopted the draft of amendments and changes to the national criminal-procedural code. The new draft suggests exclusion of Articles “insult” and “libel”, i.e. these Articles will be decriminalized.

Rustam Mengliev, Minister of Justice, Dushanbe

The Tajik Minister of Justice Rustam Mengliev made comments for the media on the recent adoption of amendments to the national criminal-procedural code decriminalizing the Articles 135 and 136 (libel and insult respectively).

The decriminalization of these Articles was suggested by the Tajik President Emomali Rakhmon. From now on, cases referring to libel, insult or defamation will be considered in the context of the national civil code.

Punishment for libel, insult or defamation will be performed in the form of obligatory public refutation or financial penalties as moral compensation based upon a civil court verdict. Previously, the crimes on the “libel” Article could entail imprisonment up to five years, and “insult” – up to two years.

3. Actions of public officials defining the status of the media and the factual situation

1 October

Davlatali Nazriev, head of Information, Analysis and Foreign Policy Planning, Ministry of Foreign Affairs, Dushanbe

Davlatali Nazriev, the head of the Tajik Foreign Ministry’s Information Department told the media that the Tajik state agencies’ press services are going to create their own professional union.

The official added that the decision was made at a recent seminar “Interaction between state agencies’ press services and the media”. The seminar was conducted by the Tajik National Association of Independent Mass Media (NANSMIT) jointly with the Tajik Foreign Ministry’s Information, Analysis and Foreign Policy Planning Department. It was financially supported by the NGO International Media Support.

The initiative group comprising representatives of the Tajik Foreign Ministry, press services of the Ministries of Health and Education, the National Security Committee, the Women and Family Affairs Committee under the government will be in charge of organizational issues and convening the foundation conference.

The professional union of the state press services will be created with the purpose of exchanging experience, implementation of educational programs, developing communication and public relation strategies ensuring better access to all official sources of information.

4. Journalists protecting their professional and civil rights

2 October

Tajik media organizations have launched and educational and public awareness campaign “100 days for the freedom of TajNet” on Facebook. The action was initiated by NANSMIT, the Tajik Union of Journalists and the Media Alliance of Tajikistan.

According to organizers, the action will attract attention of the civil society and the government to the problems of the freedom of expression in the Internet.

The organizers issued a statement saying that democratic values and the rule of law are in jeopardy. The Internet is seen as a free information space; however, the recent limitations in the free expression and pluralism in the Tajik segment of the Internet – the so-called TajNet – raises serious concern in the society.

The organizers expressed hope that their constructive suggestions would help in resolving conflicts in the media environment.

10 October

IWPR, Dushanbe

The British Institute for War and Peace Reporting (IWPR) launched the second stage of trainings for media professionals in the area of journalistic investigations.

On 8-9 October, 14 young journalists from Dushanbe, Kulyab, Khorog and Khujand took part in a seminar to learn the methodologies of collecting and analyzing information and documents from web resources. Another aspect of the training was studying legislation for conducting investigations.

The first series of thematic trainings was held in June 2012.

The project “Laboratory for Journalistic Investigations” is implemented under financial support of the Open Society Institute in Tajikistan.

11 October

The Tajik Union of Journalists, NANSMIT, the National Media Council, and the Media Alliance of Tajikistan published a statement addressed to the Tajik Minister of Interior and the head of Tajikistan’s Traffic Police. The statement concerns the road accident on 9 October, which entailed hospitalization of Iskandar Firuz, the correspondent of the Persian Service of BBC.

13 October

All media, Khujand, Sughd province

On 13 October 2012, the Tajik National Association of Independent Media convened a meeting at a Journalists’ Club attended by media professionals and human rights activists.

Participants discussed opportunities for creating a trade union of media workers in Tajikistan.

The idea of setting up such an institution emerged long ago; however, some media professionals say that the trade union might duplicate the functions of the Tajik Union of Journalists.

31 October

The British Institute for War and Peace Reporting (IWPR) held a seminar in Dushanbe on the topic “Cooperation between the mass media and human rights watchdogs”.

Participants practiced to organize and conduct press conferences and interviews. Besides that, journalists and human rights activists exchanged information about recent amendments in Tajikistan’s legislation and methodologies enabling them to attract attention to their activities.

II. VIOLATIONS OF RIGHTS IN THE MEDIA 

1. Violation of legal procedures

3 October

TV Jahonoro, Gafurov, Sughd province

The Sughd province Prosecutor’s Office initiated administrative proceedings against the editor of the TV station Jahonoro Mohira Vokhidova. The editor is accused of spreading information about the fire at Korvon market in Dushanbe.

The director of TV Jahonoro Makhmudjon Dadoboev told NANSMIT that straight after broadcasting the information about the accident taken from the web site TojNews, he was called to the Sughd province branch of the National Security Committee.

Shortly afterwards, Dadoboev was called to the Prosecutor’s Office where he was asked to write a report. After a while, the director learned that the Prosecutor’s Office applied to the court complaining that “the TV station violated Article 373 of Tajikistan’s Administrative Code”.

Muhabbat Juraeva, the lawyer from the Sughd province Legal Support Center says that Article 373 of the Administrative Code concerns violations in dissemination of media products. “The actions of TV Jahonoro have no legal violations per se”, — she said. – “TojNews is a registered news resource, and dissemination of information taken from that web site cannot be ssen as something illegal”.

The Tajik broadcasting legislation says that information can be freely disseminated if the source is indicated (mentioned in broadcasting), and the broadcaster bears no responsibility whatsoever.

2. Violation of the freedom of information

The Tajik weekly Asia Plus published an article titled “Voluntary-compulsory subscription” (#74, 01.10.2012) revealing the growing administrative pressure on certain categories of subscribers. “Officials in a democratic country still cannot give up the legacy of the communist time”, — the article says.

In educational institutions, even in kindergartens, employees are forced to subscribe to particular newspapers and magazines.

The authors of the article describe “administrative tools”, which public servants apply to support the state-owned printing media.

III. CONFLICTS AND VIOLATIONS IN THE MEDIA

1. Demands on refutation

3 October

TV Jahonoro, Sughd province

Muhabbat Juraeva, the lawyer of the Sughd province Legal Support Center told the NANSMIT monitoring service that the Prosecutor’s Office initiated an administrative case against the editor of Jahonoro TV Mohira Vokhidova.

The administrative case is initiated in relation to a TV report about the fire at the Korvon market in Dushanbe.

The Sughd province Prosecutor’s Office confirmed the information about the alleged administrative violation. A source in the Prosecutor’s Office confirmed that the case is passed to the court. The source refused to provide comments on the situation saying that this is a prerogative of the court.

On 30 October, the director of TV Jahonoro was dismissed from his position – allegedly, because his TV station disseminated the information taken from the Internet about the accident in Dushanbe.

Dodoboev said that the decision was taken by the founder of Jahonoro Mr. Ohunov. The lawyer Juraeva considers that the founder sees the incident as something that has had a negative impact on the TV station.

Davlatali Nazriev, the head of the Tajik Foreign Ministry’s Information Department told
the media that the Tajik state press services work poorly in terms of timely and objective information.

This statement was made at a round table “Contemporary challenges in Tajikistan’s information environment and the role of the media” regarding the recent military operation in the city of Khorog, administrative center of Gorno Badakhshan.

According to Nazriev, such events require timely and objective media coverage. The official added that certain western media were providing inadequate information.

20 September

Shodi Shabdolov, chairman of the Communist Party of Tajikistan, Dushanbe

The leader of the Tajik Communist Party and parliamentarian Shodi Shabdolov told the Tajik weekly Asia Plus about his recent meetings with the electorate in Sughd province.

Shabdolov said that the population in certain districts – Ainy and Matchoh in particular – live in conditions of information vacuum.

“The printing media available in those districts do not meet requirements of their readers. The people want to learn more about the situation and events in their country, in their region. They want to learn about the laws being adopted and the decisions of the government. They want to know what’s going on in GBAO», — he noted.

25 September

Muzaffar Ashurov, President’s Office, Dushanbe

Muzaffar Ashurov, head of the Department of Constitutional and Human Rights under the President’s Executive Office stated that “[during the events in Khorog] certain mass media were providing materials justifying the actions of criminals and creating conditions for repetition of such events”.

The official made this remark on 24 September, at an OSCE meeting on commitments in the area of human dimension.

The accusation against the Tajik non-state media was voiced after a presentation made by Olga Tutubalina, deputy editor of the Asia Plus weekly.

The Tajik weekly Asia Plus published an interview with a journalist and researcher Ibrohim Usmonov (#72, 24.09.2012) where he contemplates the impact of the Internet on Tajikistan’s information environment.

“The traditional media have lost their former influence. Only the information network can provide the audience with instant response on current events. The Internet is a weapon of mass influence; however, it does not mean that the authorities should impose prohibitions. On the contrary, the government must be open – to avoid grounds for criticism”.


2. Actions of public officials defining the status of the media and the factual situation

21 September
Beg Zukhurov, head of the government’s Communication Service, Dushanbe

On 21 September, after a two-month blocking, some of the local Internet service providers opened access to the web site of the Tajik leading news agency Asia Plus.

It remains unknown whether the Tajik Communication Service under the President has officially ordered to unblock access to the web resource. According to Asia Plus, the providers did not have any written errand on the blocking; however, it is quite obvious that there was a “command from above”. The expert see a clear relation between the blocking of access to the web site and the recent publications in Asia Plus criticizing the authorities.

Commenting the situation, Beg Zukhurov, head of the Communication Service told Radio Ozodi (the Tajik service of Radio Free Europe / Radio Liberty) that he has ordered the Internet providers to restore access to Asia Plus. “The time has come for this web site [Asia Plus] to become a decent one and stop attempts of inappropriate criticism”, — he was quoted as saying.

In the mean time, Zukhurov told Asia Plus that he gave no any orders on blocking. “We have a special group [for censorship] tracing the web sites defaming the country and the government, but Asia Plus is not in that list”, — he said.

The official added that the Internet providers blocked the web site on their own initiative, and he is ready to figure out why they have done this.

3. Factual situation in the media and the freedom of speech

7 September

Shabakai Avval, state TV

On 7 September, the Tajik state television switched to digital broadcasting in the mode 24×7.

Shabakai Avval (the First Channel) intends to expand its broadcasting coverage not only in the country, but also abroad.

At present, four state TV channels broadcast in the country – Shabakai Avval, Safina, Jahonnamo, and Bakhoriston (a TV station for children).

7 September

All media, Dushanbe

At a round table “The role of mass media in public stability and national unity” held in Dushanbe on 7 September, some journalists proposed to wear certain “uniforms” while covering specific events.

On 6 September, Tajik journalists went to a march of protest organized spontaneously by vendors from one of the markets in Dushanbe to protect their rights. A number of media professionals had problems with the law enforcement agencies. The chief editor of the Tajik weekly Nigokh Saimiddin Dustov spent three hours at a police station.
29 September

The Persian TV Channel, Dushanbe

The Tajik weekly Asia Plus published an article titled “What impedes the launching of a Persian television in Dushanbe?” (#71, 20.09.12).

According to the medium, the Tajik Foreign Ministry is trying to create a proper legal basis for the TV channel, which would belong to three neighboring Persian-language countries – Tajikistan, Afghanistan and Iran with the headquarters in Dushanbe.

“As soon as the legal basis is created, the editing and broadcasting equipment delivered from Iran will be exempted from customs fees”, — Davlatali Nazriev, head of the Foreign Ministry’s information department was quoted as saying.

According to the Iranian embassy in Dushanbe, the equipment worth of 2 million Euro has been delivered a while ago. “However, the equipment got stuck in the airport, and the Tajik customs service insists on paying $400 thousand for clearance”, — a source i9n the embassy said.

The Iranian source also added that the constant postponing of the launching of the TV channel has something to do with the official position of the Afghan authorities regarding the broadcasting policy of the new TV station and with ideological and creative contents of TV programs.

On 27 September, the Public Union under the President’s Office held a session of the Social Partnership Club to discuss the issues of formation of secure information space and switching to digital broadcasting.

Shahlo Akobirova, director of NGO Khoma and Asomuddin Atoev, director of the virtual academy ICT (information-communication technology) made relevant presentations regarding digital broadcasting and secure information space.

In 2006, among 104 states, Tajikistan signed the Treaty “Geneva 2006” obliging the country to entirely switch to digital broadcasting.

A number of relevant issues emerged in this regard; one of them is the necessity to strengthen the secure information space and informed society.

The Tajik media community asked the Prosecutor General’s Office to express a legal opinion regarding the actions of law enforcement officers against reporters who covered the events in Dushanbe, which followed the fire at the Korvon wholesale market on the southern outskirts of the capital.

Commenting on that, chairman of NANSMIT Nuriddin Karshiboev said that at least nine cases of violations of professional rights were registered by the monitoring service on 6 September, during the spontaneous march of protest attended by the market vendors.

Karshiboev added that leaders of Tajik media organizations have developed a plan of actions to protect the interests of the media community and ensure solidarity. The main provision of the plan is a dialogue with heads of the law enforcement agencies and the Prosecutor General’s Office.
20 September

The Tajik media community intends to apply to the General Prosecutor’s Office with a complaint about violations of rights of journalists in the country.

The Tajik news portal TJinform quoted Khilvatshokh Khojaev, Secretary General of the Tajik Media Council as saying that the number of cases of violation of professional and civil rights of journalists has grown recently”.

Khojaev referred to the recent events in the city of Khorog, administrative center of Gorno Badakhshan and the incidents in Dushanbe related to the Korvon market disorders. Law enforcement officers confiscated photo and video equipment; some reporters were detained at police stations.

II. VIOLATION OF RIGHTS IN THE MEDIA

1. Limitation of access to information 

24 September

Information agency TojNews, Dushanbe

The Tajik Communication Service under the President’s Office gave an order to local Internet service providers to block access to the TojNews web portal.

According to the Indem company, the founder of TojNews, the Internet service providers initially received SMS messages from the Communication Service, which was followed by an official written notification.

“Regrettably, the Internet providers – in defiance of the national legislation and the international law – have followed the order and closed access to www.tojnews.org, — says a statement issued by Indem. — For ten days, we have been trying to receive official comments on these actions, but to no avail”.

The statement also says that the actions of the authorities are unlawful; this can push the independent media towards adversaries of the government.

2. Impediments to professional activities

7 September

Saimuddin Dustov, editor, Nigokh weekly, Dushanbe

On 6 September, the Tajik police detained Saimuddin Dustov, the chief editor of the Nigokh weekly who was collecting information about the incident at the Korvon market in Dushanbe and protestors who tried to defend their commercial rights. After four hours, the editor was released, and the police apologized for the detention.

According to Dustov, the police officers acted impolitely. The situation changed when the chief of the municipal police arrived to speak with protestors.

7 September
Information agency Tojnews, Dushanbe

A correspondent of the Tajik private news agency Tojnews told the NANSMIT monitoring service about the impediments created by police officers for journalists covering the marching of protesters from the Korvon market in Dushanbe. The journalist told that she is personally acquainted with the head of the municipal police, and she asked him to take measures and let the media do their work. The police commander gave an order to his subordinates, but the situation was barely under control, and the officers kept treating journalists like other protestors, i.e. quite rudely.
7 September

Asia Plus weekly, Dushanbe

On 6 September, the Tajik police detained temur varki, the correspondent of the Tajik weekly Asia Plus who had an errand to cover the incident at the Korvon market in Dushanbe.

According to the journalist, certain individuals in plain clothes who introduced themselves as police officers forcedly took his ID card away from him, after which he did not see them anymore.
7 September

Ozodagon weekly, Dushanbe

Ibodullohi Tohir, correspondent of the Ozodagon weekly was also detained by the police on 6 September.

According to him, law enforcement officers were dressed in plain clothes. The journalist decided not to apply to any law enforcement agency regarding the fact of violation of his professional rights since he cannot identify the persons who detained him.
7 September

BBC, Persian service, Dushanbe

Zevarshohi Muhammad, correspondent of the Persian service of BBC was detained by the police on 6 September. Unknown individuals dressed in civilian clothes told him to put away his video camera; then, he was pushed by the crowd, and the camera smashed down. Protestors helped him to pick up the pieces of the broken video camera.
3. Violation of the principle of transparency of judicial proceedings

3 September
Khoji Akbar Turajonzoda, theologian, Khujand, Sughd province 

On 3 September, the Khujand municipal court commenced hearings on the lawsuit initiated by the Tajik theologian Khoji Akbar Turajonzoda.

The chair of the proceeding Matluba Khabibulloeva did not permit the Asia Plus correspondent to participate in the process explaining that “the court is conducting only preliminary hearings”.

According to Faizinisso Vokhidova, the defense lawyer protecting the interests of Turajonzoda, the Tajik legislation does not have any restrictions for media coverage, even if the proceedings are preliminary.

It should be noted that the defendants in Turajonzoda’s litigation, where he complains about his affected honor and dignity, are the head of the Sughd province Council of Ulems (spiritual leaders), the chief imam of the Isfara city mosque, and a journalist from the Sughd province television.


4. Violation of economic rights

11 September
All media, Dushanbe

On 10 and 11 September, the Sharki Ozod printing facility experienced continuous outages of electricity. Sharki Ozod provides its services to almost all Tajik periodicals.

Editors and media managers have different opinions about the reason of the blackouts. Some of them say that it has a lot to do with the incident at the Korvon market.

The municipal electric company said that the outages have no political grounds whatsoever; they were caused by damages within the grid. The line that feeds the printing house goes through the territory of Korvon – the market affected by the recent massive fire.

13 September

Maorifi Tojikiston, Ministry of Education, Dushanbe

Shodi Shokirzoda, editor of Maorifi Tojikiston, the official printing body of the Ministry of Education approached the Tajik State Postal Service complaining about the money that should have been received a while ago from subscribers. It is noted in his letter that the editing board is unable to print new issues of the magazine because the transfer still has not been made.

In August 2012, the Monitoring Service received 21 reports. Nine of them describe the factual situation in the media in the light of social, legal and political environment; eleven reports describe direct violations of rights of media professionals; and one report describes conflicts and accusations against the media and journalists.

 

I. POLITICAL, SOCIAL, ADMINISTRATIVE AND LEGAL CLIMATE IN THE COUNTRY DEFINING THE FACTUAL SITUATION IN THE MEDIA

1. Public speeches and statements of superior officials defining the factual situation in the mass media

10 August

Rustam Mengliev, Minister of Justice

On 9 August, the UN Committee on Liquidation of All Forms of Racial Discrimination in Geneva finished discussions on Tajikistan’s reports on legal, judicial, administrative and other measures against racial discrimination.

According to the UN News Center, the Tajik Justice Minister noticed that the racial equality is properly described in the National Constitution as a basic rights.

 

There are 137 ethnic groups residing in the country with the population of 7,8 million people.
According to Mengliev, citizens of Tajikistan enjoy freedom of speech; many information agencies and mass media operate in different languages.

2. The media environment and the freedom of speech

2 August
Reporters Without Borders (RSF)

The Paris-based organization Reporters Without Borders issued a statement concerning the clocking of a number of web sites belonging to news agencies, naming Tajikistan “a country standing close to the category of enemies of the Internet”.
The statement says that “by censoring online publications, the Tajik authorities bring their country closer to Kazakhstan; and in the future, the country might find itself close to such countries as Uzbekistan and Turkmenistan”.

RSF published its statement in response to the blocking of Tajik and foreign web resources, such as Asia Plus, BBC and YouTube.
6 August
SMT TV, Dushanbe

The only private TV company operating in the Tajik capital – Simoi Mustakili Tojikiston (Independent Television of Tajikistan) commenced broadcasting on 6 August on a new frequency.

According to Zinatullo Ismoilov, founder and director of the TV company, in the last two years, his TV station could not broadcast because the Russian Federal TV channel “RTR-Planeta” occupied the very same broadcasting frequency.
From now on, SMT TV will broadcast from 8 a.m. to 2 p.m. and from 6 to 11 p.m. in Dushanbe and its suburbs – Rudali, Varzob, Vahdat, Gissar, Shahrinav, Yavan and Faizabad districts.
SMT first launched its programs in 2007. Since 2010, it’s been dormant because of the technical reasons – the coincidence of broadcasting frequencies.
22 August

All media, Khujand
The Sughd province administration conducted an sociological opinion poll in Spitamen district with the purpose to improve access to information among the local population. The district is not fully covered by the four existing Tajik state TV station. At present, broadcasting signals from 8 TV and 16 radio stations from Uzbekistan and 2 Kyrgyz TV stations are available in the district.
3. Journalists protecting their rights

3 August

All media, Dushanbe

The Tajik Union of Journalists, the Tajik National Association of Independent Mass Media, the Tajik Media Alliance and the Tajik Media Council issued a joint statement condemning unlawful actions of the Government Communication Service limiting access to national and foreign information resources. The media organizations urge the state body to stop lawlessness in the national information space.
The authors indicate that the limited access to information is seen as a rude violation of constitutional rights in the country; it becomes a “stable trend” in the policy of the State Communication Service.

 

In 2012, the Communication Service has repeatedly blocked access to 15 information resources. The stance of Internet providers is seen as a troublesome symptom – uncomplainingly, they follow the Service’s unlawful demands becoming accomplices in the violation of rights of companies and individuals.
National and foreign media organizations have reacted against the restricting actions by the Tajik communication authorities; concrete measures have been suggested to regulate the Internet in the country. “We believe that the ignoring of the international and domestic information standards by the state body negatively affects the image of Tajikistan. It also undermines the trust of interstate structures and financial institutions to democratic transformations conducted by the Tajik authorities”, — the statement says.

 

8 August

Asia Plus, Dushanbe

The Asia Plus information agency approached all media organizations in Tajikistan seeking support in relation to the recent event. “We are going to appeal to the court, but in view of the fact that it is difficult to technically prove the blocking of our web site by the state communication service, we need to collect necessary documents. We need to consult our lawyers, and we need support of the Tajik mass media”, — the statement says.
“The situation is very complicated, but we cannot tolerate this anymore. Today, they are chasing us; tomorrow, they will be harassing the other media, enjoying their impunity. The apathy among our colleagues-journalists can only enforce their sense of impunity and permissiveness”, — the statement says.

9 August

Reporters Without Borders (RSF) and NANSMIT

The international organization Reporters Without Borders (RSF) and the Tajik National Association of Independent Mass Media (NANSMIT) sent a joint statement to Beg Zukhurov, head of the Tajik government Communication Service.

 

The media organizations are concerned about the Communication Service’s intention to create a specific group to monitor online publications and trace “offensive or defaming” publications.
The statement says that such system of control can lead to total blocking of online publications and closing access to web sites. “We agree that libel should be punishable; however, such cases should be considered in court, where complainants and defendants have access to fair trial”.

 

It is also noted in the statement that in recent years, the Communication Service under the government continuously persecutes private news organizations by blocking their web sites.
14 August

Asia Plus, Dushanbe

On 14 August 2012, the Tajik private news agency Asia Plus changed its address —http://www.asia-plus.tj. Since 2010, the web site had a different IP domain — news.tj, which is still legitimate under an agreement with the Tajik Ministry of Culture. The Asia Plus managers say that the access to the news agency’s web site is still limited due to the order of the government Communication Service to the Internet providers.

Zebo Tajibaeva, executive director of Asia Plus told NANSMIT that her agency is preparing an appeal to court against the head of the Communication Service, Beg Zukhuruv concerning the illegal blocking to the web site.

15 August

All media, Dushanbe

The public organization The Union of Young Russian Compatriots held a training in Dushanbe for journalists working for Russian-language media. Representatives of all regions took part in the seminar conducted from 15 to 18 August.
Michail Petrushkov, chairman of the organization told the media that this is the first seminar of that kind held in Tajikistan; it is financially supported by the foundation Russian World.
“The organizers pursued the goal to efficiently counter xenophobia, racial, national, religious discrimination and other negative trends in relations between peoples and ethnicities”, — he added.

II. VIOLATIONS OF RIGHTS IN THE MEDIA

1. Limited access to information

1 August

Asia Plus, Dushanbe

On 1 August 2012, the government Communication Service ordered domestic Internet providers to block access to the web site belonging to the Tajik private news agency Asia Plus.
Zebo Tajibaeva, the web site’s editor told the media that the Communication Service received the information about the blockage from one of the Internet providers.

 

In the last ten days, this is the second registered case of blocking. The editor cannot get in touch with the Communication Service administration.
1 August

The U.S. Embassy in Dushanbe

On 1 August 2012, the Embassy of the United States in Dushanbe published a statement expressing concern about continuous blocking of certain web sites and the Youtube resource.

Inter alia, the statement says that the United States consider the freedom of expression in public places, as well as in the Internet as a universal right. We support freedom of speech everywhere in the world, and we urge other countries to follow these principles. When ideas are blocked, information is deleted, talks are silenced, and people have limited access to information, the Internet loses its essence for us. We will continue discussions on this topic with the government of Tajikistan.
17 August

Radio Sweden

Radio Sweden criticized the telecommunication company TeliaSonera, which, according to the media, is blocking access to more than 50 web sites in Tajikistan. According to the REGNUM news agency, this company provides Internet services under the brand name of Т-Cell.

Thomas Johnson, head of TeliaSonera’s information service told Radio Sweden that the blocking of access to the web resources is performed at the direction of the Tajik authorities. He personally considers that access to the Internet must be free, but his company has to follow the instructions of the hosting country, which interprets its decisions as those based on national security interests.
The T-Cell company has been repeatedly criticized by human rights organizations. Accroding to Swedish media, TeliaSonera also assists the Tajik authorities in controlling the political opposition in the country.

 

TeliaSonera works in Moldova (Moldcell), Uzbekistan (Ucell), Azerbaijan (Azercell), Tajikistan (Тcell), Georgia (Geocell) and Kazakhstan (Kcell).
2. Ungrounded limitation of access to information

25 August

www.tojnews.org, Dushanbe

On 25 August 2012, Zainuddin Orifi, correspondent of the information agency www.tojnews.org tried to find information about 880 tons of cement shipped from the Iranian city of Shiraz to Tajikistan.
The journalist got this information from the head of the Shiraz a railway station. In order to get clarifications, he approached the Tajik Ministry of Economic Development and Trade and to the Tajik Railways Company. Both state agencies refused to share any information referring to various reasons and excuses.
3. Detention of a journalist

10 August
Pazvok newspaper, Kulyab, Khatlon province

On 9 August 2012, Bakhriddin Sangimadov, correspondent of the newspaper Pazhvok was detained by law enforcement servicemen in Shurabad district and delivered to the Farkhor district interior department in Khatlon province.

 

According to Orzu Khamidov, editor of Pazhvok, his correspondent went to Shurabad to visit his parents. In his house, he was captured by people in camouflage uniforms. They did not present any warrant, put a bag upon his head, and told his parents that they will release him after a brief interrogation.
The editor is concerned that the correspondent was detained in one place, was delivered to another one and placed in the police detention center. He is also worrying that neither relatives, nor friends are allowed to see Sangimadov, whereas the police do not explain the reason for detention.
Sangimadov wrote many articles disclosing social and economic problems in Shurabad district. Apart from working for Pazhvok, he also cooperated with the newspaper Anvori Donish, a printing body of the Kulyab State University and the British Institute for War and Peace Reporting (IWPR).

Bakhriddin Sangimadov was released after two days spent at the interior department detention center in Farkhor district, Khatlon province.
4. Journalist facing threats

28 August
Farazh weekly, Dushanbe

On 27 August 2012, the judge Khakimov of the Farkhor district court threatened to punish Makhmudjon Rakhmatov, correspondent of the Farazh weekly who tried to use his recording device during the hearings. Rakhmatov claims that the judge used insulting words addressing to the correspondent’s mother.
The journalist told the media that his family had a land dispute with one resident of the village they live in; the judge conducted hearings “in absentia” and pronounced a verdict in the favor of the rival.
Rakhmatov’s mother was summoned to the court; she came with her son. When the judge noticed that the journalist records his obscenities against the lady, he tried to attach him. The judge ordered his subordinates to lead the journalist away verbally promising to “settle accounts” with him.

 

The court officials called a policeman, after which Rakhmatov was accompanied to the police station. Shortly afterwards, he was released.

 

The journalist intends to appeal against the judge for his incorrect behavior.

5. Impediments to professional activities

31 August

Radio Ozodi (Liberty), Dushanbe

On 31 August 2012, Abdullohi Ashur and Zarangezi Navruzshoh, correspondents of Radio Ozodi in came to the residency of the Tajik president to collect information about a protest rally organized by Tajik university enrollees. The students were displeased with answers they received from the Ministry of Education regarding admission exams in Kazakh universities, and they came to complain to the president Emomali Rakhmon.
The police politely asked the journalists to leave the place; however, they had done their work. On the way back to their office, they were stopped by people in military uniform who ordered to follow them to the police station. Those servicemen were also polite with the correspondents, although they took away their technical equipment.

 

The journalists spend only half of an hour at the Ismoili Somoni district police station, and were released after a conversation with the head of the police. The official told the journalists that the detention proved to be a misunderstanding.

6. Violation of procedural norms of criminal legislation


22 August
Najot weekly, PIRT, Dushanbe

The Pyanj district interior department launched an investigation into the beating of Khikmatullo Saifullozoda, the editor of the Najot weekly, the printing body of the Tajik Party of Islamic Renaissance (PIRT). Last winter, Saifullozoda was attacked by unknown assailants.

 

According to deputy chairman of PIRT Makhmadali Khait, last year, Saifullozoda applied to the Sino district prosecutor’s office, but no investigation was conducted. The PIRT administration applied to the prosecutor general’s office, but even then, the party received no response. The prosecutor general only verbally confirmed that he personally will monitor the investigation into the case. Only recently, it has been found out that the case is transferred to the Pyanj district interior department.

 

The PIRT deputy leader expressed bewilderment – Saifullozoda was attacked in Dushanbe, and the criminal case is being investigated in Pyanj district, hundreds of kilometers from the capital.

 

PIRT sees a clear relation between Saifullozoda’s professional activities and the attack. “The Pyanj district interior department tries to relate the beating to “family conflicts”, but it has no ground. This is a political case, and it concerns his professional activities”, — the party deputy chairman said.

7. Ungrounded accusation of abetment

4 August

Prosecutor General’s Office, Dushanbe

The Tajik Prosecutor General’s Office accused local and foreign media of abetting the organizers of clashes in Khorog, the administrative center of Gorno-Badakhshan and of “assisting to implement the planned program of foreigners”. The statement is expressed in an official letter addressed to the TojNews information agency.

The letter also says that “some local and foreign journalists openly support the implementation of a planned program running errands of enemies of our state and people”.

III. CONFLICTS. VIOLATIONS AND ACCUSATIONS AGAINST THE MEDIA AND JOURNALISTS

1. Requirements on refutation of unverified information

10 August

Shabakai Avval, Tajik state television, Dushanbe

On 7 August 2012, the Shohmansur district court in Dushanbe held hearings on the lawsuit initiated by the mayor’s office against the Tajik State TV station Shabakai Avval (The First Channel), and obliged the administration of the medium to present an apology to the municipal administration within one month.
Apart from that, Shabakai Avval must present a refutation of information previously presented in the news program Akhbor.

 

The mayor’s office press secretary Shavkat Saidov told the media that the city administration is satisfied with the court’s decision. “The municipal authorities did not require any moral or material compensation from the TV station”, — he added.

In July, the mayor’s office approached the court in Shohmansur district claiming that the TV channel criticized the municipal authorities one-sidedly and in a biased manner.

According to Radio Free Europe / Radio Liberty, the US deputy foreign minister in charge of South and Central Asia stated that the situation in Tajikistan in the area of freedom of speech raises concern in Washington. The official made this statement on 24 July at the US Congress.
We urge Dushanbe to respect the freedom of press and restrain from interfering in media business”, — he said.

On 24 July, the OSCE representative on the media freedom Dunja Mijatović made a statement expressing concern over the blocking of the Asia Plus news agency’s web site www.news.tj by the Tajik communications authorities and urged the government to lift the ban from this information source and from a number of other web resources.

“The Internet must remain an open source of information, according to commitments in the area of the freedom of speech made by the OSCE member states. Although the issues of security are important, they cannot become impediments to the free information flow. There is no security without freedom in the media. People should have opportunities to receive information from various sources, and the media should have opportunities to cover any developments, even such special ones as the issues of security”, — said Mijatović.

The OSCE envoy also stated that the authorities must guarantee unlimited access to the Internet, and urged to open access to www.news.tj and other sources as soon as possible.

“I have mentioned in my letter addressed to the Tajik foreign minister Khamrokhon Zarifi on 19 July that the OSCE office on the media freedom is ready to provide the Tajik authorities with an expertise on this and on other issues regarding the media freedom, including the Internet”, — she stated.

The European Union shares concern expressed by the OSCE representative regarding the blocking of access to the web site of the Asia Plus news agency.
“We reconfirm our position voiced in our statement issued on 8 March 2012 regarding the blocking of a number of web sites by the Tajik authorities. We agree with the OSCE media freedom representative that the issues of security, regardless of lawfulness, should not be a basis for limiting access to information.

The US Embassy in Dushanbe

The US Embassy in Dushanbe urged Tajikistan to respect basic rights and freedoms, including the freedom of speech and free information flow. The Embassy issued a special statement regarding the situation in Khorog, the administrative center of Gorno Badakhshan Autonomous Province (GBAO).

2. Actions of public officials defining the factual situation in the mass media

5 July
Emomali Rakhmon, President of Tajikistan, Dushanbe

On 4 July, the President of Tajikistan Emomali Rakhmon signed a document containing relevant changes and amendments to the national criminal code, which decriminalize the articles on libel and defamation. This category of former “crimes” can be considered only at civil courts.

The initiative to abolish Articles 135 (libel) and Article 136 (insult) was suggested by the President at a meeting with journalists on 10 March on the occasion of the 100-th anniversary of the Tajik printing media.

Many experts say that the abolishing of criminal responsibility for insult and libel will be conducive for development of the freedom of speech and will strengthen democracy in the country.

6 July
The EU office in Tajikistan, Dushanbe

The European Office in Tajikistan appreciates the changes and amendments in the Tajik criminal code abolishing criminal responsibility for libel and defamation.
The EU office published a statement saying that the adopted measure will have a positive impact on the freedom of press and expression.

Along with that, the EU office states that Article 137 (public insult of the President and libel against him) in the Tajik criminal code still stipulates criminal responsibility in certain cases. The EU office urges the Tajik authorities to abolish this particular Article.

In its statement, the European Union office confirms its commitments expressing its desire to continue support in the area of freedom of the media and expression.

Ramazon Rakhimov, interior minister, Dushanbe

On 20 July, the Tajik interior minister Ramazon Rakhimov told the media that his agency continues investigations of cases of assaults on journalists.
The official also noted that the ministry of interior is especially concerned about the frequent assaults on media professionals. The ministry has set up a special team to investigate such cases.

According to the Asia Plus news agency, the Tajik government tax committee has increased the profit tax for certain printing outlets up to 25 percent, which can have a negative impact on them, and, accordingly, will increase the cost of printing products.

In 2009, the President ordered to decrease the income tax from 25 to 15 percent to create favorable conditions for the domestic printing media. In May 2009, the Parliament adopted relevant changes in the national tax legislation.

3. Factual situation in the media and freedom of speech

6 July

The European Union representation in Dushanbe appreciates the adopted amendments in Tajikistan’s criminal code decriminalizing two articles previously stipulating criminal responsibility for libel and insult.

On 5 July, the EU office launched a statement saying that this measure will make a positive contribution to the respect of the freedom of the media and the freedom of expression in Tajikistan.

At the same time, the EU Delegation notes that the Article 137 of the Criminal Code of the Republic of Tajikistan still foresees criminal charges in certain cases and encourages the Tajik Government to abolish the remaining provisions and thus entirely decriminalize defamation.

The EU reconfirms its commitment to continue to support the development of media freedom and freedom of expression in Tajikistan.

Asadullo Rakhmonov, State TV and Radio Committee under the government

At a press conference hold on 21 July in Dushanbe, the chairman of the government TV and Radio Committee Asadullo Rakhmonov stated that there is no rivalry among the state TV companies.

In his opinion, the four existing TV channels are divided thematically. “Should we have two TV channels like “Jahonoro”, a couple of channels like “Safina” and 5-6 channels for children, there might be a competition, and the audience would think of choosing among them. So far, the viewers have not had any alternative”, — he added.

Committee to Protect Journalists, New York, USA

The New York based organization Committee to Protect Journalists issued a statement condemning the blocking of access to the leading independent news website Asia-Plus. Access has been blocked for the third time in two months. Tajikistan’s Internet Service Providers are doing the blocking at the behest of the Communications Agency, which cites “technical reasons.”

The Russian news agency RIA-Novosti’s website has also been blocked, joining YouTube, two other Russian news sites (Lenta.ru and Vesti.ru), two news portals specializing in Central Asia (Fergananews.com and Centrasia.ru) and the local forum Pamir-vesti.ru, all of which have been filtered and blocked in recent days.

Access to the BBC’s website was blocked on 30 July and restored the next day.

“Tajikistan already came close to being added to the list of countries ‘under surveillance’ in our last ‘Enemies of the Internet’ report in March and now the government is clearly doing everything possible to make sure it is added next year, regardless of the negative impact this would have on the country’s image,” Reporters Without Borders said.

“By making increasingly systematic use of cyber-censorship, Tajikistan is falling in line with his Central Asian neighbour Kazakhstan and could eventually catch up with neighbouring Uzbekistan and Turkmenistan, which practice even more drastic forms of online censorship.”

The management of Asia-Plus has voiced frustration with the repeated blocking and with the resulting financial losses and damage to its reputation. Its executive director said Asia-Plus would conduct no more negotiations with the head of the Communications Agency, Beg Zukhurov, because the agreements reached in the past had not been respected.

The surge in website blocking coincided with violent clashes between government forces and armed groups in Khorog, the capital of the southern autonomous province of Gorno-Badakhshan, which neighbours Afghanistan. It is very hard to establish the exact situation in Khorog but it seems to have calmed down in the past few days and the army has begun to withdraw.

Dozens of people are thought to have died in the clashes but there is a great deal of variation in the casualty estimates.

The Tajik private weekly Farazh published an interview with the professor of the Tajik National University Kirinshohi Sharifzoda who contemplates the status of the Tajik mass media. In his opinion, the decriminalization of the articles on defamation and libel cannot resolve all problems media professional face.

Sharifzoda noted another problem – the absence of sizes of penalties in the Tajik legislation, which public officials use for their own benefit.

4. Journalists protecting their civil and professional rights

On 2-3 July, the OSCE office in Dushanbe held the Sixth Annual human development preparatory meeting.

The issues of freedom of speech and new mass media, freedom from tortures, freedom of religion, freedom of expression, access to justice, human rights, democratic elections standards and other topics were discussed at the sessions.

The Tajik Union of Journalists, the Tajik National Association of Independent Mass Media, the Tajik Media Alliance, the Media Council, public organizations Indem and Oriyono Media issued a joint statement calling on the media and journalists to restrain from publications containing information that is not properly verified – regarding the military clashed in the Tajik city of Khorog, administrative center of Gorno Badakhshan.

“Certain web sites and blogs try to add local and religious flavor to the developments in GBAO, which could create grounds for negative consequences in the country. Tajikistan is our common home, and Badakhshan is its integral part”.

The media organizations also expressed concern over the limited access to the web site belonging to the leading Tajik information agency Asia Plus.

It is also mentioned in the statement that the Tajik law enforcement agencies – the National Security Committee, the Interior Ministry and the Prosecutor General’s office – should create a joint press center to disseminate objective information about the events in GBAO.

II. VIOLATIONS OF RIGHTS IN THE MEDIA

1. Impediments to professional activities

4 July
Asia Plus, Dushanbe

A Tajik-Russian investor applied to the President of Tajikistan and to the Tajik judicial bodies soliciting support in a business matter. The investor accuses the governor of Tojik Soidirot Bonk (one of the Tajik banks) of misappropriation of a big business venture, which they founded together.

The Asia Plus correspondents contacted the governor of Tojik Soidirot Bonk, but he refused to answer any questions.

27 July
Asia Plus, Khorog, GBAO

The governor of Gorno-Badakhshan Autonomous Province Kodir Kosim did not allow the correspondent of the Asia Plus weekly Ramziya Mirzobekova to participate in the work of the special commission, which tries to establish the number of victims among civilians in Khorog. The commission was created on 25 July.

“The official personally told me that I am now welcome in this commission”, — said Mirzobekova. It should be noted that the Asia Plus correspondent was elected by local residents since the composition of the commission was defined at a municipal meeting of public activists.

2. Ungrounded requirements on censorship

17 July
Beg Zukhurov, head of the government communications service, Dushanbe

Head of the Tajik government communications service Beg Zukhurov told the Asia Plus information agency that he intends to create a public organization to monitor publications in the Internet to control the contents in terms of morality and national security.

Zukhurov said that the organization, which will be registered at the Ministry of Justice, will comprise of volunteers, among whom there will be local journalists.

Zukhurov noted that the public organization will have no affiliation to the state communications service. He clarified that his agency is the initiator of creation of such an “inspection group” to trace online “libelous” and “defamatory” materials.

Zukhurov also noted that some online publications contain indecent comments and words insulting the Tajik supreme authorities. “The volunteers from this public organization will trace and detect the authors of these comments”, — said the official.

Tajik Association of Internet Providers, Dushanbe

The Tajik National Association of Internet Providers expressed serious concern over the initiative on the creation of a special online monitoring group.

“It turns out that Tajikistan introduces censorship in the Internet”, — said Parvina Ibodova, chair of the Association. She considers that the initiative is unlawful since the Tajik Constitution prohibits any censorship.

“The head of the communications service says that the group will be created to prevent libel and insult of high-ranking officials. However, such actions can be taken only after a relevant judicial decision. Moreover, how young technicians will define what is a libel and what is not?”, — Ibodova added.

3. Unlawful limitation of access to information

24 July
www.news.tj, Asia Plus, Dushanbe

On 23 July, the Tajik government communications service ordered all domestic providers to block access to the web site www.news.tj belonging to the leading information agency Asia Plus.

Zebo Tajibaeva, executive director of Asia Plus told the media that the agency did not receive any official notification; they only had an SMS message.

Commenting on that, the chair of the Tajik Association of Internet Providers Parvina Ibodova said that the regulator, i.e. the communications service under the President ordered to close access by “technical reasons”.

Several Internet service providers have unblocked access to the Asia Plus’s web site www.news.tj

Previously, the government communications service explained that the access was blocked by technical reasons. However, the media community is confident that the authorities are hiding the truth about the military operation in Gorno Badakhshan.

Experts and human rights watchdogs interpret the hasteful actions of the authorities as a serious violation of the basic constitutional right – free access to information. Moreover, this has led to panicking and dissemination of various rumors about the events in that region.

Several Internet service providers in Tajikistan have blocked access to YouTube, the biggest video hosting service.

According to the local Internet service providers, the order came from the government communications service.

Prior to that, the Internet service providers blocked access to several local web sites belonging to the Tajik and foreign information agencies.

4. Ungrounded limitation of access to information

In March 2005, the Tajik President Emomali Rakhmon issued a decree obliging all ministries and government agencies to conduct regular monthly press conferences. This measure was targeted to ensuring transparency of the state agencies’ activities and better access of the media to official sources of information.

In September 2011, amendments were introduced to the President’s decree, according to which heads of government agencies must meet with the media only twice a year.

Many experts consider that these arrangements are having a negative impact on the situation in the area of freedom of the media.

23 July
Ministry of Energy and Industry, Dushanbe

At a press conference held on 23 July in Dushanbe, the Tajik minister of energy and industry refused to provide a comment about the situation at the Roghun hydropower plant. He stated that his agency is involved only in the issues regarding the project design documentation.

Many contractors who worked at the object have been “sent on leave”. The official structures do not provide any comments although they repeatedly promised to ensure transparency in everything, which concerns the Roghun plant.

The minister suggested journalists to approach the joint stock company “Roghun HPP”.

1. Demands to refute incorrect information

2 July
The First State TV Channel, Dushanbe

The Mayor’s Office filed a case against the First Tajik TV Channel for a program criticizing the municipal administration (Asia Plus, #50, 2 July 2012). According to the Mayor’s Office press secretary Shavkat Saidov, the TV Channel was biased in the covering of municipal problems ignoring refutations presented by the administration.

The Tajik Interior Ministry demands the media to restrain from publishing non-verified information (Imruz News, #111, 2 July 2012).

The ministry says that some of the recent publications with ungrounded allegations might impede proper investigation of the assassination of Kholmumin Safarov, who was a relative to the President Rakhmon.

The Najot weekly, printing body of the Tajik Islamic Renaissance Party, Dushanbe

The Najot weekly, the printing body of the Tajik Islamic Renaissance Party (PIRT) (#27, 4 July 2012) published an article “Religion and politics have always been together”. The article was published in response to another publication in a district newspaper Nasimi Ifsara (#19, 25 May 2012).

The Najot weekly says that the article in Nasimi Isfara is written in a “communist style” and contains a number of poorly justified accusations against PIRT and its leaders. The authors state that the article instigates hatred to Islam. Quoting segments from the original publication, the authors note that “PIRT does not help any development, but only criticizes shortcomings in the government”.

In response to these accusations, the Najot weekly states that the Islamic Renaissance Party has an intention to change the socio-political situation in the country for the better instead of praising the authorities – like the others do.

It is also noted in the article that similar publications appear in the media time and again sowing the seeds of hatred in the Tajik society.
